 1        AN ACT in relation to the Metropolitan Water  Reclamation
 2    District.

 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:

 5        Section 5.  The Metropolitan Water  Reclamation  District
 6    Act is amended by changing Section 4.32 as follows:

 7        (70 ILCS 2605/4.32) (from Ch. 42, par. 323.32)
 8        Sec. 4.32. Veteran's preference.
 9        (a)  A  person  who  served  in the National Guard or the
10    United States Army, Navy,  Air  Force,  Marine  Corps,  Coast
11    Guard,  or  Reserves  and  was honorably discharged from that
12    service or who is currently serving in the National Guard  or
13    the Reserves is entitled to a veteran's preference under this
14    Section.
15        (b)  The  Director of Personnel shall give preference for
16    an original or promotional appointment to a person qualifying
17    for a veteran's preference  under  this  Section  whose  name
18    appears  on  an  original or promotional eligible register by
19    adding 5 points to the final grade that the  person  receives
20    as the result of any original or promotional examination held
21    on  or after the effective date of this amendatory Act of the
22    93rd General Assembly.
23        (c)  The changes made to this Section by this  amendatory
24    Act  of  the 93rd General Assembly are not intended to affect
25    any  preference  granted  under  this  Section   before   the
26    effective date of this amendatory Act.
27        Persons who were engaged in the military or naval service
28    of the United States during the years 1898, 1899, 1900, 1901,
29    1902, 1914, 1915, 1916, 1917, 1918, or 1919, any time between
30    September  16, 1940 and July 25, 1947, or any time during the
31    national emergency between June  25,  1950  and  January  31,

 1    1955,  and  who  were honorably discharged therefrom, and all
 2    persons who were engaged in such military  or  naval  service
 3    during any of said years, any time between September 16, 1940
 4    and  July 25, 1947, or any time during the national emergency
 5    between June 25, 1950 and January 31, 1955, or any time  from
 6    August  5,  1964 until the date determined by the Congress of
 7    the United States as the end of Viet Nam hostilities,  or  at
 8    any time between August 6, 1990 and the date the Persian Gulf
 9    Conflict  ends  as prescribed by Presidential proclamation or
10    order, who are now or may hereafter be on inactive or reserve
11    duty in  such  military  or  naval  service,  not  including,
12    however,  persons  who  were  convicted  by  court-martial of
13    disobedience of orders, where such disobedience consisted  in
14    the  refusal  to  perform  military  service on the ground of
15    alleged religious or conscientious  objections  against  war,
16    shall be preferred for appointments to offices, positions and
17    places  of  employment  in  the  classified  service  of  the
18    District,  provided  they  are  found to possess the business
19    capacity necessary for the proper discharge of the duties  of
20    such  office,  position, or place of employment as determined
21    by  examination  for  original  entrance.  The  Director   of
22    Personnel   on  certifying  from  any  existing  register  of
23    eligibles resulting from the holding of  an  examination  for
24    original  entrance  or  any register of eligibles that may be
25    hereafter created of persons who have taken and  successfully
26    passed the examinations provided for in this Act for original
27    entrance  commenced  prior  to September 1, 1949, shall place
28    the name or names of such persons at the head of any existing
29    eligible register or list of eligibles that shall be  created
30    under  the  provisions  of  this  Act  to  be  certified  for
31    appointment.  The Director of Personnel shall give preference
32    for original appointment to persons as hereinabove designated
33    whose names appear on any  register  of  eligibles  resulting
34    from  an  examination  for  original  entrance held under the

 1    provisions of this Act and commenced on or after September 1,
 2    1949 by adding to the final grade average which they received
 3    or will receive as the result of  any  examination  held  for
 4    original  entrance,  five  points.  The numerical result thus
 5    attained shall be applied by the  Director  of  Personnel  in
 6    determining the position of such persons on any eligible list
 7    which  has  been created as the result of any examination for
 8    original entrance commenced on or after September 1, 1949 for
 9    purposes of preference in certification and appointment  from
10    such eligible list.
11        Every certified Civil Service employee who was called to,
12    or  who volunteered for, the military or naval service of the
13    United States at any time during the years specified in  this
14    Act,  or  at any time between September 16, 1940 and July 25,
15    1947 or any time during the national emergency  between  June
16    25,  1950  and  January  31, 1955, or any time from August 5,
17    1964 until the date determined  by  Congress  of  the  United
18    States  as  the  end  of Viet Nam hostilities, or at any time
19    between August 6, 1990 and the date the Persian Gulf conflict
20    ends as prescribed by Presidential proclamation or order, and
21    who were honorably discharged therefrom or who are now or who
22    may hereafter be on inactive or reserve duty in such military
23    or naval service, not including, however,  persons  who  were
24    convicted  by  court  martial of disobedience of orders where
25    such  disobedience  consisted  in  the  refusal  to   perform
26    military  service  on  the  ground  of  alleged  religious or
27    conscientious objections against war, and whose names  appear
28    on existing promotional eligible registers or any promotional
29    eligible  register that may hereafter be created, as provided
30    for  by  this  Act,  shall  be  preferred   for   promotional
31    appointment   to  civil  offices,  positions  and  places  of
32    employment in the classified civil service  of  the  District
33    coming under the provisions of this Act.
34        The  Director  of  Personnel  shall  give  preference for

 1    promotional appointment to persons as hereinabove  designated
 2    whose names appear on existing promotional eligible registers
 3    or  promotional  eligible  registers  that  may  hereafter be
 4    created by adding to  the  final  grade  average  which  they
 5    received  or  will  receive  as the result of any promotional
 6    examination   commencing   prior   to   September   1,   1949
 7    three-fourths of one point for  each  6  months  or  fraction
 8    thereof of military or naval service not exceeding 48 months,
 9    and  by  adding  to  the  final grade average which they will
10    receive as the result of  any  promotional  examination  held
11    commencing  on or after September 1, 1949 seven-tenths of one
12    point for each 6 months or fraction thereof  of  military  or
13    naval  service not exceeding 30 months.  The numerical result
14    thus attained shall be applied by the Director  of  Personnel
15    in  determining  the position of such persons on any eligible
16    list which has been created or will be created as the  result
17    of any promotional examination held hereunder for purposes of
18    preference   in   certification  and  appointment  from  such
19    eligible list.
20        No person shall receive the preference for a  promotional
21    appointment granted by this Section after he has received one
22    promotion  from an eligible list on which he was allowed such
23    preference  and  which  was  prepared  as  a  result  of   an
24    examination held on or after September 1, 1949.
25        No  person  entitled to preference or credit for military
26    or naval service  hereunder  shall  be  required  to  furnish
27    evidence  or  record  of  honorable  discharge from the armed
28    forces before any examination held under  the  provisions  of
29    this Act but such preference shall be given after the posting
30    or  publication  of  the eligible list or register and before
31    any certification or appointments are made from the  eligible
32    register.

 1        Section  99.   Effective  date.  This Act takes effect on
 2    January 1, 2004.
