 1        AN ACT concerning higher education.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The University of Illinois Act is amended by
 5    adding Section 7a-5 as follows:

 6        (110 ILCS 305/7a-5 new)
 7        Sec.  7a-5.  Violation  of   policy   governing   student
 8    conduct; fine.
 9        (a)  If  a  student has paid a fine to a municipality for
10    conduct that violated an ordinance and the University imposes
11    a fine on that student  for  the  same  conduct  because  the
12    conduct   violated  a  university  policy  governing  student
13    conduct (and if  the  student  has  submitted  proof  to  the
14    University  that  a  fine  was  imposed  by  and  paid to the
15    municipality for the same conduct), then the University  must
16    credit  the  fine  paid  to the municipality against the fine
17    imposed by the University.
18        (b)  If a student has paid a fine to the  University  for
19    conduct  that  violated a university policy governing student
20    conduct and a municipality imposes a fine on that student for
21    the same conduct because the conduct  violated  an  ordinance
22    (and  if  the  student  has submitted proof to the University
23    that a fine was imposed by  the  municipality  for  the  same
24    conduct), then the University must pay to the municipality on
25    behalf of the student the fine imposed by the municipality or
26    that  part  of  the  fine  that equals the amount of the fine
27    imposed by the University, whichever is less.

28        Section 10.  The Southern Illinois University  Management
29    Act is amended by adding Section 8a-5 as follows:

 2        Sec.   8a-5.  Violation   of   policy  governing  student
 3    conduct; fine.
 4        (a)  If a student has paid a fine to a  municipality  for
 5    conduct that violated an ordinance and the University imposes
 6    a  fine  on  that  student  for  the same conduct because the
 7    conduct  violated  a  university  policy  governing   student
 8    conduct  (and  if  the  student  has  submitted  proof to the
 9    University that a  fine  was  imposed  by  and  paid  to  the
10    municipality  for the same conduct), then the University must
11    credit the fine paid to the  municipality  against  the  fine
12    imposed by the University.
13        (b)  If  a  student has paid a fine to the University for
14    conduct that violated a university policy  governing  student
15    conduct and a municipality imposes a fine on that student for
16    the  same  conduct  because the conduct violated an ordinance
17    (and if the student has submitted  proof  to  the  University
18    that  a  fine  was  imposed  by the municipality for the same
19    conduct), then the University must pay to the municipality on
20    behalf of the student the fine imposed by the municipality or
21    that part of the fine that equals  the  amount  of  the  fine
22    imposed by the University, whichever is less.

23        Section  15.  The Chicago State University Law is amended
24    by adding Section 5-62 as follows:

25        (110 ILCS 660/5-62 new)
26        Sec.  5-62.  Violation  of   policy   governing   student
27    conduct; fine.
28        (a)  If  a  student has paid a fine to a municipality for
29    conduct that violated an ordinance and the University imposes
30    a fine on that student  for  the  same  conduct  because  the
31    conduct   violated  a  university  policy  governing  student
32    conduct (and if  the  student  has  submitted  proof  to  the

 1    University  that  a  fine  was  imposed  by  and  paid to the
 2    municipality for the same conduct), then the University  must
 3    credit  the  fine  paid  to the municipality against the fine
 4    imposed by the University.
 5        (b)  If a student has paid a fine to the  University  for
 6    conduct  that  violated a university policy governing student
 7    conduct and a municipality imposes a fine on that student for
 8    the same conduct because the conduct  violated  an  ordinance
 9    (and  if  the  student  has submitted proof to the University
10    that a fine was imposed by  the  municipality  for  the  same
11    conduct), then the University must pay to the municipality on
12    behalf of the student the fine imposed by the municipality or
13    that  part  of  the  fine  that equals the amount of the fine
14    imposed by the University, whichever is less.

15        Section  20.  The  Eastern  Illinois  University  Law  is
16    amended by adding Section 10-62 as follows:

17        (110 ILCS 665/10-62 new)
18        Sec.  10-62.  Violation  of  policy   governing   student
19    conduct; fine.
20        (a)  If  a  student has paid a fine to a municipality for
21    conduct that violated an ordinance and the University imposes
22    a fine on that student  for  the  same  conduct  because  the
23    conduct   violated  a  university  policy  governing  student
24    conduct (and if  the  student  has  submitted  proof  to  the
25    University  that  a  fine  was  imposed  by  and  paid to the
26    municipality for the same conduct), then the University  must
27    credit  the  fine  paid  to the municipality against the fine
28    imposed by the University.
29        (b)  If a student has paid a fine to the  University  for
30    conduct  that  violated a university policy governing student
31    conduct and a municipality imposes a fine on that student for
32    the same conduct because the conduct  violated  an  ordinance

 1    (and  if  the  student  has submitted proof to the University
 2    that a fine was imposed by  the  municipality  for  the  same
 3    conduct), then the University must pay to the municipality on
 4    behalf of the student the fine imposed by the municipality or
 5    that  part  of  the  fine  that equals the amount of the fine
 6    imposed by the University, whichever is less.

 7        Section  25.  The  Governors  State  University  Law   is
 8    amended by adding Section 15-62 as follows:

 9        (110 ILCS 670/15-62 new)
10        Sec.   15-62.  Violation   of  policy  governing  student
11    conduct; fine.
12        (a)  If a student has paid a fine to a  municipality  for
13    conduct that violated an ordinance and the University imposes
14    a  fine  on  that  student  for  the same conduct because the
15    conduct  violated  a  university  policy  governing   student
16    conduct  (and  if  the  student  has  submitted  proof to the
17    University that a  fine  was  imposed  by  and  paid  to  the
18    municipality  for the same conduct), then the University must
19    credit the fine paid to the  municipality  against  the  fine
20    imposed by the University.
21        (b)  If  a  student has paid a fine to the University for
22    conduct that violated a university policy  governing  student
23    conduct and a municipality imposes a fine on that student for
24    the  same  conduct  because the conduct violated an ordinance
25    (and if the student has submitted  proof  to  the  University
26    that  a  fine  was  imposed  by the municipality for the same
27    conduct), then the University must pay to the municipality on
28    behalf of the student the fine imposed by the municipality or
29    that part of the fine that equals  the  amount  of  the  fine
30    imposed by the University, whichever is less.

31        Section 30.  The Illinois State University Law is amended

 1    by adding Section 20-62 as follows:

 2        (110 ILCS 675/20-62 new)
 3        Sec.   20-62.  Violation   of  policy  governing  student
 4    conduct; fine.
 5        (a)  If a student has paid a fine to a  municipality  for
 6    conduct that violated an ordinance and the University imposes
 7    a  fine  on  that  student  for  the same conduct because the
 8    conduct  violated  a  university  policy  governing   student
 9    conduct  (and  if  the  student  has  submitted  proof to the
10    University that a  fine  was  imposed  by  and  paid  to  the
11    municipality  for the same conduct), then the University must
12    credit the fine paid to the  municipality  against  the  fine
13    imposed by the University.
14        (b)  If  a  student has paid a fine to the University for
15    conduct that violated a university policy  governing  student
16    conduct and a municipality imposes a fine on that student for
17    the  same  conduct  because the conduct violated an ordinance
18    (and if the student has submitted  proof  to  the  University
19    that  a  fine  was  imposed  by the municipality for the same
20    conduct), then the University must pay to the municipality on
21    behalf of the student the fine imposed by the municipality or
22    that part of the fine that equals  the  amount  of  the  fine
23    imposed by the University, whichever is less.

24        Section  35.  The Northeastern Illinois University Law is
25    amended by adding Section 25-62 as follows:

26        (110 ILCS 680/25-62 new)
27        Sec.  25-62.  Violation  of  policy   governing   student
28    conduct; fine.
29        (a)  If  a  student has paid a fine to a municipality for
30    conduct that violated an ordinance and the University imposes
31    a fine on that student  for  the  same  conduct  because  the

 1    conduct   violated  a  university  policy  governing  student
 2    conduct (and if  the  student  has  submitted  proof  to  the
 3    University  that  a  fine  was  imposed  by  and  paid to the

 5    credit  the  fine  paid  to the municipality against the fine
 6    imposed by the University.
 7        (b)  If a student has paid a fine to the  University  for
 8    conduct  that  violated a university policy governing student
 9    conduct and a municipality imposes a fine on that student for
10    the same conduct because the conduct  violated  an  ordinance
11    (and  if  the  student  has submitted proof to the University
12    that a fine was imposed by  the  municipality  for  the  same
13    conduct), then the University must pay to the municipality on
14    behalf of the student the fine imposed by the municipality or
15    that  part  of  the  fine  that equals the amount of the fine
16    imposed by the University, whichever is less.

17        Section 40.  The  Northern  Illinois  University  Law  is
18    amended by adding Section 30-62 as follows:

19        (110 ILCS 685/30-62 new)
20        Sec.   30-62.  Violation   of  policy  governing  student
21    conduct; fine.
22        (a)  If a student has paid a fine to a  municipality  for
23    conduct that violated an ordinance and the University imposes
24    a  fine  on  that  student  for  the same conduct because the
25    conduct  violated  a  university  policy  governing   student
26    conduct  (and  if  the  student  has  submitted  proof to the
27    University that a  fine  was  imposed  by  and  paid  to  the
28    municipality  for the same conduct), then the University must
29    credit the fine paid to the  municipality  against  the  fine
30    imposed by the University.
31        (b)  If  a  student has paid a fine to the University for
32    conduct that violated a university policy  governing  student

 1    conduct and a municipality imposes a fine on that student for
 2    the  same  conduct  because the conduct violated an ordinance
 3    (and if the student has submitted  proof  to  the  University

 5    conduct), then the University must pay to the municipality on
 6    behalf of the student the fine imposed by the municipality or
 7    that part of the fine that equals  the  amount  of  the  fine
 8    imposed by the University, whichever is less.

 9        Section  45.  The  Western  Illinois  University  Law  is
10    amended by adding Section 35-62 as follows:

11        (110 ILCS 690/35-62 new)
12        Sec.   35-62.  Violation   of  policy  governing  student
13    conduct; fine.
14        (a)  If a student has paid a fine to a  municipality  for
15    conduct that violated an ordinance and the University imposes
16    a  fine  on  that  student  for  the same conduct because the
17    conduct  violated  a  university  policy  governing   student
18    conduct  (and  if  the  student  has  submitted  proof to the
19    University that a  fine  was  imposed  by  and  paid  to  the
20    municipality  for the same conduct), then the University must
21    credit the fine paid to the  municipality  against  the  fine
22    imposed by the University.
