 1                     AMENDMENT TO HOUSE BILL 940

 2        AMENDMENT NO.     .  Amend House Bill  940  by  replacing
 3    the title with the following:
 4        "AN ACT concerning public works contracts."; and

 5    by  replacing  everything  after the enacting clause with the
 6    following:

 7        "Section 1.  Short title. This Act may be  cited  as  the
 8    Public Works Contract Change Order Act.

 9        Section  5.  Change  orders;  bidding.  If a change order
10    for any public works contract (i) is entered into by  a  unit
11    of local government or school district and (ii) authorizes or
12    necessitates  any  increase in the contract price that is 25%
13    or more of the original contract price, then portion  of  the
14    contract  that  is  covered  by  the  change  order  must  be
15    resubmitted  for  bidding  in  the  same manner for which the
16    original contract was bid. Bidding for  the  portion  of  the
17    contract  covered  by  the  change  order  is  subject to any
18    requirements to employ females and minorities on  the  public
19    works  project  that  existed at the bidding for the original
20    contract, together with any  later  requirements  imposed  by
21    law.

 1        Section  10.  Home  rule.   A  home  rule  unit  may  not
 2    regulate  its  public  works  contracts  in  manner  that  is
 3    inconsistent  with this Act.  This Section is a limitation of
 4    home rule powers under subsection (i) of Section 6 of Article
 5    VII of the Illinois Constitution.

 6        Section 15.  Mandates.   This  Act  is  exempt  from  the
 7    reimbursement requirements of the State Mandates Act.

 8        Section  90.  The State Mandates Act is amended by adding
 9    Section 8.27 as follows:

10        (30 ILCS 805/8.27 new)
11        Sec. 8.27. Exempt mandate.   Notwithstanding  Sections  6
12    and  8 of this Act, no reimbursement by the State is required
13    for the implementation of any mandate created by  the  Public
14    Works Contract Change Order Act.".
