 1        AN ACT concerning public works contracts.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 1.  Short title. This Act may  be  cited  as  the
 5    Public Works Contract Change Order Act.

 6        Section  5.  Change  orders;  bidding.  If a change order
 7    for any public works contract (i) is entered into by  a  unit
 8    of  local government or school district, (ii) is not procured
 9    in accordance with the  Illinois  Procurement  Code  and  the
10    State  Finance  Act, and (iii) authorizes or necessitates any
11    increase in the contract price that is 50%  or  more  of  the
12    original contract price, then portion of the contract that is
13    covered  by  the change order must be resubmitted for bidding
14    in the same manner for which the original contract  was  bid.
15    Bidding for the portion of the contract covered by the change
16    order  is  subject  to any requirements to employ females and
17    minorities on the public works project that  existed  at  the
18    bidding  for  the  original contract, together with any later
19    requirements imposed by law.

20        Section  10.  Home  rule.   A  home  rule  unit  may  not
21    regulate its public works  contracts  in  a  manner  that  is
22    inconsistent  with this Act.  This Section is a limitation of
23    home rule powers under subsection (i) of Section 6 of Article
24    VII of the Illinois Constitution.

25        Section 15.  Mandates.   This  Act  is  exempt  from  the
26    reimbursement requirements of the State Mandates Act.

27        Section  90.  The State Mandates Act is amended by adding
28    Section 8.27 as follows:

 1        (30 ILCS 805/8.27 new)
 2        Sec. 8.27. Exempt mandate.   Notwithstanding  Sections  6
 3    and  8 of this Act, no reimbursement by the State is required
 4    for the implementation of any mandate created by  the  Public
 5    Works Contract Change Order Act.
