 1        AN ACT in relation to public health.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The Lead Poisoning Prevention Act is amended
 5    by adding Section 7.3 as follows:

 6        (410 ILCS 45/7.3 new)
 7        Sec. 7.3.  Video rental fee;  screening  of  pregnant  or
 8    lactating women.
 9        (a)  A  fee  of  $0.02  is  imposed  on every rental of a
10    videotape or video disc in this State. The person who owns  a
11    videotape  or  video disc that is rented to another person is
12    responsible for paying the fee imposed under this Section and
13    may collect an amount not exceeding the  amount  of  the  fee
14    from  the  person  renting the videotape or video disc. Every
15    owner of a videotape or video disc that is rented to  another
16    person  shall  keep  records as required by the Department by
17    rule to ensure the collection of  all  fees  due  under  this
18    Section.
19        (b)  Every  owner  of  a  videotape or video disc that is
20    rented to another person shall pay all fees  collected  under
21    this  Section  to  the  State  Treasurer  for  deposit into a
22    special account in the Lead Poisoning Screening,  Prevention,
23    and Abatement Fund. The owner shall pay the fees quarterly as
24    provided by the Department by rule.
25        (c)  Beginning  July  1,  2004,  moneys  in  the  special
26    account created under subsection (b) shall be appropriated to
27    the  Department  for  the  purpose  of  funding  a program to
28    provide lead  poisoning  screening  for  women  who  are  (i)
29    determined  to  reside in an area defined as high risk by the
30    Department, (ii) age 13 or older, and (iii)  either  pregnant
31    or lactating.
