SYNOPSIS AS INTRODUCED:
 
30 ILCS 575/8i

    Amends the Business Enterprise for Minorities, Women, and Persons with Disabilities Act. In provisions requiring State agencies and public institutions of higher education to encourage prime vendors to amend a contract with no contract goal, provides that, if a prime vendor is not willing to amend a contract to include the recommended goal of the State agency or public institution of higher education, the contract shall be rebid immediately.

1    AN ACT concerning finance.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Business Enterprise for Minorities, Women,
5and Persons with Disabilities Act is amended by changing
6Section 8i as follows:
 
7    (30 ILCS 575/8i)
8    (Section scheduled to be repealed on June 30, 2029)
9    Sec. 8i. Renewals. State agencies and public institutions
10of higher education shall:
11        (a) review all existing contracts prior to the time of
12    renewal to determine if the contract goal is being met by
13    the prime vendor;
14        (b) review all existing contracts prior to the time of
15    renewal to determine if the contract goal should be
16    increased based upon market conditions and availability of
17    firms certified pursuant to this Act;
18        (c) review existing contracts with no contract goal to
19    determine if a goal can be established; if it is
20    determined that a contract goal can be established, the
21    State agency or public institution of higher education
22    shall encourage the prime vendor to amend the contract to
23    include the contract goal; if a prime vendor is not

1    willing to amend a contract to include the recommended
2    goal of the State agency or public institution of higher
3    education, the contract shall be rebid immediately; if the
4    prime vendor amends the contract to include the
5    recommended goal of the State agency or public institution
6    of higher education, the prime vendor a prime contractor
7    shall be required to complete a utilization plan to
8    demonstrate how it intends to meet the contract goal; and
9        (d) review renewals at least 6 months prior to renewal
10    to allow adequate time to rebid if it is determined that
11    the prime contractor has not demonstrated good faith
12    efforts towards meeting the contract goal.
13    All renewals shall be subject to any amendments made to
14this Act, or amendments made to any administrative rules
15adopted under this Act, that become effective prior to the
16date of renewal.
17    The requirements of this Section shall not apply to
18construction and construction-related services procurements.
19    This Section is operative on and after January 1, 2018.
