SYNOPSIS AS INTRODUCED:

305 ILCS 5/5-35.6 new

    Amends the Medical Assistance Article of the Illinois Public Aid Code. Provides that subject to federal approval, beginning January 1, 2025, and each year thereafter, the monthly personal needs allowance for a nursing facility resident who is determined to be eligible for medical assistance shall increase by an amount equal to the percentage increase, if any, in the consumer price index-u during the preceding 12-month calendar year. Provides that subject to federal approval, beginning January 1, 2025, for a supportive living facility resident who is determined eligible for medical assistance, in addition to the minimum monthly personal needs allowance authorized under the Social Security Act, the State shall pay an amount that is equal to the percentage increase, if any, in the consumer price index-u during the preceding 12-month calendar year. Provides that the monthly amount paid by the State shall be adjusted each year to reflect an increase, if any, in the consumer price index-u.

1    AN ACT concerning public aid.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Public Aid Code is amended by
5changing Sections 5-35.5 and 5-35.6 as follows:
 
6    (305 ILCS 5/5-35.5)
7    Sec. 5-35.5. Personal needs allowance; nursing home
8residents. Subject to federal approval, on and after January
91, 2024, for a person who is a resident in a facility licensed
10under the Nursing Home Care Act for whom payments are made
11under this Article throughout a month and who is determined to
12be eligible for medical assistance under this Article, the
13monthly personal needs allowance shall be $60. Subject to
14federal approval, beginning January 1, 2025, and each year
15thereafter, an eligible resident's personal needs allowance
16shall increase by an amount equal to the percentage increase,
17if any, in the consumer price index-u during the preceding
1812-month calendar year. As used in this paragraph, "consumer
19price index-u" means the index published by the Bureau of
20Labor Statistics of the United States Department of Labor that
21measures the average change in prices of goods and services
22purchased by all urban consumers, United States city average,
23all items, 1982-84 = 100.

4facility residents. Subject to federal approval, beginning
5January 1, 2025, for a person who is a resident in a supportive
6living facility authorized under Section 5-5.01a for whom
7payments are made under this Article throughout a month and
8who is determined to be eligible for medical assistance under
9this Article, in addition to the minimum monthly personal
10needs allowance authorized under Section 1902(q) of Title XIX
11of the Social Security Act (42 U.S.C. 1396a(q)), the State
12shall pay an amount that is equal to the percentage increase,
13if any, in the consumer price index-u during the preceding
1412-month calendar year. The monthly amount paid by the State
15shall be adjusted each year to reflect an increase, if any, in
16the consumer price index-u. As used in this paragraph,
17"Consumer price index-u" means the index published by the
18Bureau of Labor Statistics of the United States Department of
19Labor that measures the average change in prices of goods and
20services purchased by all urban consumers, United States city
21average, all items, 1982-84 = 100.
