AMENDMENT TO SENATE BILL 2663

2    AMENDMENT NO. ______. Amend Senate Bill 2663 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Public Water District Act is amended by
5adding Section 28.2 as follows:
 
6    (70 ILCS 3705/28.2 new)
7    Sec. 28.2. Alternate method of annexation. The board of
8trustees of any water district may annex territory which is
9not within the corporate limits of the water district if:
10        (1) the new territory is contiguous to the annexing
11    water district and not currently served by another water
12    district; and
13        (2) the new territory is without a source of quality
14    water not contaminated by methane and is within 3 miles of
15    a source of a methane contamination.
16    The annexation shall be accomplished only by ordinance and

1the ordinance shall include a description of the annexed
2territory and a map of the annexed territory certified as true
3and accurate by the clerk of the water district shall be filed
4with the county clerk of the county in which the annexed
5territory is located. The territory to be annexed shall be
6considered to be contiguous to the water district
7notwithstanding that the territory to be annexed is divided
8by, or that the territory to be annexed is separated from the
9water district by, one or more railroad right of waters,
10public easements, or properties owned by a public utility, a
11forest preserve district, a public agency, or a not-for-profit
12corporation. A two-thirds vote of the board is required to
13annex such territory to the district and action of the board
14shall be by ordinance of annexation and the vote on such
15ordinance shall be entered upon the records of the district.
 
16    Section 99. Effective date. This Act takes effect upon
17becoming law.".
