SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/6-105  from Ch. 95 1/2, par. 6-105

    Amends the Illinois Vehicle Code. Provides that the Secretary of State may issue such additional temporary driver's licenses to an applicant as are necessary to allow the applicant to drive during the pendency of an investigation and determination of all facts relative to such applicant's eligibility for such a license, valid for such a period as is appropriate, but in no event for longer than 90 days each. Effective immediately.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by
5changing Section 6-105 as follows:
 
6    (625 ILCS 5/6-105)  (from Ch. 95 1/2, par. 6-105)
7    Sec. 6-105. Instruction permits and temporary licenses for
8persons 18 years of age or older.
9    (a) Except as provided in this Section, the Secretary of
10State upon receiving proper application and payment of the
11required fee may issue an instruction permit to any person 18
12years of age or older who is not ineligible for a license under
13paragraphs 1, 3, 4, 5, 7, or 8 of Section 6-103, after the
14applicant has successfully passed such examination as the
15Secretary of State in his discretion may prescribe.
16    1. An instruction permit entitles the holder while having
17the permit in his immediate possession to drive a motor
18vehicle, excluding a motor driven cycle or motorcycle, upon
19the highways for a period of 12 months after the date of its
20issuance when accompanied by a licensed driver who is 21 years
21of age or older, who has had a valid driver's license
22classification to operate such vehicle for at least one year
23and has had one year of driving experience with such

1classification and who is occupying a seat beside the driver.
2    2. A 12 month instruction permit for a motor driven cycle
3or motorcycle may be issued to a person 18 years of age or
4more, and entitles the holder to drive upon the highways
5during daylight under the direct supervision of a licensed
6motor driven cycle operator or motorcycle operator with the
7same or greater classification, who is 21 years of age or older
8and who has at least one year of driving experience.

11    (c) The Secretary of State may issue a temporary driver's
12license to an applicant for a license permitting the operation
13of a motor vehicle while the Secretary is completing an
14investigation and determination of all facts relative to such
15applicant's eligibility to receive such license, or for any
16other reason prescribed by rule or regulation promulgated by
17the Secretary of State. Such permit must be in the applicant's
18immediate possession while operating a motor vehicle, and it
19shall be invalid when the applicant's driver's license has
20been issued or for good cause has been refused. In each case
21the Secretary of State may issue the temporary driver's
22license for such period as appropriate but in no event for
23longer than 90 days. The Secretary may issue such additional
24temporary driver's licenses to an applicant as are necessary
25to allow the applicant to drive during the pendency of the
26investigation, valid for such a period as is appropriate, but

1in no event for longer than 90 days each.
