AMENDMENT TO SENATE BILL 336

2    AMENDMENT NO. ______. Amend Senate Bill 336, AS AMENDED,
3with reference to page and line numbers of House Amendment No.
41, on page 24, immediately below line 22, by inserting the
5following:
 
6    "Section 33. The Illinois Public Aid Code is amended by
7changing Section 5-5.05 as follows:
 
8    (305 ILCS 5/5-5.05)
9    Sec. 5-5.05. Hospitals; psychiatric services.
10    (a) On and after July 1, 2008, the inpatient, per diem rate
11to be paid to a hospital for inpatient psychiatric services
12shall be $363.77.
13    (b) For purposes of this Section, "hospital" means the
14following:
15        (1) Advocate Christ Hospital, Oak Lawn, Illinois.
16        (2) Barnes-Jewish Hospital, St. Louis, Missouri.

20        (37) A hospital with a distinct part unit for
21    psychiatric services that begins operating on or after
22    July 1, 2008.
23    For purposes of this Section, "inpatient psychiatric
24services" means those services provided to patients who are in
25need of short-term acute inpatient hospitalization for active
26treatment of an emotional or mental disorder.

1    (b-5) Notwithstanding any other provision of this Section,
2and subject to appropriation, the inpatient, per diem rate to
3be paid to all safety-net hospitals for inpatient psychiatric
4services on and after January 1, 2021 shall be at least $630.
5    (b-10) Notwithstanding any other provision of this
6Section, effective with dates of service on and after January
71, 2022, any general acute care hospital with more than 9,500
8inpatient psychiatric Medicaid days in any calendar year shall
9be paid the inpatient per diem rate of no less than $630.
10    (c) No rules shall be promulgated to implement this
11Section. For purposes of this Section, "rules" is given the
12meaning contained in Section 1-70 of the Illinois
13Administrative Procedure Act.
14    (d) This Section shall not be in effect during any period
15of time that the State has in place a fully operational
16hospital assessment plan that has been approved by the Centers
17for Medicare and Medicaid Services of the U.S. Department of
18Health and Human Services.
19    (e) On and after July 1, 2012, the Department shall reduce
20any rate of reimbursement for services or other payments or
21alter any methodologies authorized by this Code to reduce any
22rate of reimbursement for services or other payments in
23accordance with Section 5-5e.
