AMENDMENT TO SENATE BILL 1780

2    AMENDMENT NO. ______. Amend Senate Bill 1780 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Human Rights Act is amended by
5adding Section 3-102.5 as follows:
 
6    (775 ILCS 5/3-102.5 new)
7    Sec. 3-102.5. Arrest record. Unless otherwise authorized
8by law, it is a civil rights violation to refuse to, due to the
9fact of an arrest, juvenile record, or criminal history record
10information ordered expunged, sealed, or impounded under
11Section 5.2 of the Criminal Identification Act: (1) sell or
12rent or to otherwise make unavailable or deny a housing
13accommodation or dwelling to any buyer or renter; or (2) alter
14the terms, conditions, or privileges of the sale or rental of a
15housing accommodation or dwelling or the provision of services
16or facilities in connection with such housing accommodation.

1The prohibition against the use of an arrest record shall not
2preclude an owner or any other person engaging in a real estate
3transaction, or for a real estate broker or salesman, from
4prohibiting the tenant, a member of the tenant's household, or
5a guest of the tenant from engaging in unlawful activity on the
6premises.
 
7    Section 99. Effective date. This Act takes effect upon
8becoming law.".
