AMENDMENT TO SENATE BILL 481

2    AMENDMENT NO. ______. Amend Senate Bill 481 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Abraham Lincoln Presidential Library and
5Museum Act is amended by changing Section 15 and adding Section
652 as follows:
 
7    (20 ILCS 3475/15)
8    Sec. 15. Board. There shall be a Board of Trustees of the
9Abraham Lincoln Presidential Library and Museum to set policy
10and advise the Abraham Lincoln Presidential Library and Museum
11and the Executive Director on programs related to the Abraham
12Lincoln Presidential Library and Museum and to exercise the
13powers and duties given to it under Section 25 of this Act. If
14the Chief Executive Officer of the Abraham Lincoln Presidential
15Library Foundation is appointed by the Governor with advice and
16consent of the Senate, then the The Abraham Lincoln

1Presidential Library and Museum and the Abraham Lincoln
2Presidential Library Foundation shall mutually co-operate to
3maximize resources available to the Abraham Lincoln
4Presidential Library and Museum and to support, sustain, and
5provide educational programs and collections at the Abraham
6Lincoln Presidential Library and Museum. Any membership fees
7collected by the Abraham Lincoln Presidential Library
8Foundation may be used to support the Abraham Lincoln
9Presidential Library and Museum programs or collections at the
10Foundation's discretion. The Abraham Lincoln Presidential
11Library Foundation Board shall select and submit to the
12Governor's Office potential applicants for the office of Chief
13Executive Officer of the Abraham Lincoln Presidential Library
14Foundation. Within 30 days after receiving the potential
15applicants, the Governor shall appoint a Chief Executive
16Officer of the Abraham Lincoln Presidential Library Foundation
17with advice and consent of the Senate. A Chief Executive
18Officer shall serve a term of 4 years.

21    Sec. 52. Examinations and audit reports.
22    (a) While the Agency and the Abraham Lincoln Presidential
23Library Foundation are mutually co-operating as provided under
24Section 15, at least once during every biennium the Auditor
25General shall conduct a management audit of the relationship

1between the Agency and the Abraham Lincoln Presidential Library
2Foundation. The management audit shall examine, at a minimum,
3the following:
4        (1) the type and amount of direct and indirect support
5    provided by the Agency to the Foundation;
6        (2) the type and amount of direct and indirect support
7    provided by the Foundation to the Agency;
8        (3) the revenues and expenditures related to the
9    Foundation's operation of the store and restaurant;
10        (4) the extent to which the Agency has monitored its
11    agreement with the Foundation and whether required reports
12    are being submitted in a timely manner;
13        (5) any other actions taken by the Agency to oversee
14    the Foundation to ensure that the purpose of the
15    relationship is being fulfilled to the fullest extent
16    possible; and
17        (6) whether the Foundation has received any other State
18    moneys from any other State agency and, if so, the amount
19    and purpose of those funds.
20    (b) Upon written notice from the Agency indicating the date
21upon which the Agency and the Abraham Lincoln Presidential
22Library Foundation ceased mutually co-operating as provided
23under Section 15, the Auditor General shall conduct a final
24management audit of the relationship between the Agency and the
25Abraham Lincoln Presidential Library Foundation on that date.
26The management audit shall examine, at a minimum, the matters

1set forth in subsection (a), together with such other matters
2as the Agency may indicate in its notice, or the Auditor
3General may determine, are relevant to the transition of the
4Abraham Lincoln Presidential Library Foundation from mutual
5cooperation with the Agency.
6    The Agency and the State of Illinois shall have no
7responsibility for the debts or other liabilities incurred by
8the Abraham Lincoln Presidential Library Foundation on and
9after the date that mutual cooperation ceased.
10    (c) The Auditor General shall report the results of each
11audit conducted under this Section to the Governor and the
12General Assembly.
 
13    Section 99. Effective date. This Act takes effect upon
14becoming law.".
