AMENDMENT TO SENATE BILL 196

2    AMENDMENT NO. ______. Amend Senate Bill 196 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Election Code is amended by changing
5Section 1A-3 as follows:
 
6    (10 ILCS 5/1A-3)  (from Ch. 46, par. 1A-3)
7    Sec. 1A-3. Subject to the confirmation requirements of
8Section 1A-4, 4 members of the State Board of Elections shall
9be appointed in each odd-numbered year as follows:
10    (1) The Governor shall appoint 2 members of the same
11political party with which he is affiliated, one from each area
12of required residence.
13    (2) The Governor shall appoint 2 members of the political
14party whose candidate for Governor in the most recent general
15election received the second highest number of votes, one from
16each area of required residence, from a list of nominees

1submitted by the first state executive officer in the order
2indicated herein affiliated with such political party:
3Attorney General, Secretary of State, Comptroller, and
4Treasurer. If none of the State executive officers listed
5herein is affiliated with such political party, the nominating
6State officer shall be the first State executive officer in the
7order indicated herein affiliated with an established
8political party other than that of the Governor.
9    (3) The nominating state officer shall submit in writing to
10the Governor 3 names of qualified persons for each membership
11on the Board of Election to be appointed from the political
12party of that officer. The Governor may reject any or all of
13the nominees on any such list and may request an additional
14list. The second list shall be submitted by the nominating
15officer and shall contain 3 new names of qualified persons for
16each remaining appointment, except that if the Governor
17expressly reserves any nominee's name from the first list, that
18nominee shall not be replaced on the second list. The second
19list shall be final.
20    (4) Whenever all the state executive officers designated in
21paragraph (2) are affiliated with the same political party as
22that of the Governor, all 4 members of the Board to be
23appointed that year, from both designated political parties,
24shall be appointed by the Governor without nominations.
25    (5) The Governor shall submit in writing to the President
26of the Senate the name of each person appointed to the State

1Board of Elections, and shall designate the term for which the
2appointment is made and the name of the member whom the
3appointee is to succeed.
4    (6) The appointments shall be made and submitted by the
5Governor no later than April 1 and a nominating state officer
6required to submit a list of nominees to the Governor pursuant
7to paragraph (3) shall submit a list no later than March 1. For
8appointments occurring in 2019, the appointments shall be made
9and submitted by the Governor no later than May 15.
10    (7) In the appointment of the initial members of the Board
11pursuant to this amendatory Act of 1978, the provisions of
12paragraphs (1), (2), (3), (5) and (6) of this Section shall
13apply except that the Governor shall appoint all 8 members, 2
14from each of the designated political parties from each area of
15required residence.

17    Section 99. Effective date. This Act takes effect upon
18becoming law.".
