AMENDMENT TO SENATE BILL 77

2    AMENDMENT NO. ______. Amend Senate Bill 77 on page 1, by
3replacing line 5 with the following: "changing Section 9-121
4and by adding Section 9-102.5 as"; and
 
5by deleting line 5 on page 2 through line 16 on page 6; and
 
6on page 6, immediately above line 17, by inserting the
7following:
 
8    "(735 ILCS 5/9-121)
9    Sec. 9-121. Sealing of court file.
10    (a) Definition. As used in this Section, "court file" means
11the court file created when an eviction action is filed with
12the court.
13    (b) Discretionary sealing of court file. The court may
14order that a court file in an eviction action be placed under
15seal if the court finds that the plaintiff's action is

1sufficiently without a basis in fact or law, which may include
2a lack of jurisdiction, that placing the court file under seal
3is clearly in the interests of justice, and that those
4interests are not outweighed by the public's interest in
5knowing about the record. The court may order that the tenant's
6name in an action brought under Section 9-104.2 be sealed.
7    (c) Mandatory sealing of court file. The court file
8relating to an eviction action brought against a tenant under
9Section 9-207.5 of this Code or as set forth in subdivision
10(h)(6) of Section 15-1701 of this Code shall be placed under
11seal.
