SYNOPSIS AS INTRODUCED:
 
65 ILCS 5/8-1-19 new

    Amends the Illinois Municipal Code. Provides that a municipality within Cook County may not expend any funds relating to a land-based casino, including, but not limited to, legal fees or engineering costs, without approval by the electors of the municipality after a referendum. Provides that a municipality making such an expenditure shall report annually to the Comptroller all expenditures of the municipality related to a land-based casino. Limits home rule powers. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Municipal Code is amended by adding
5Section 8-1-19 as follows:
 
6    (65 ILCS 5/8-1-19 new)
7    Sec. 8-1-19. Casino expenditures.
8    (a) As used in this Section, "casino" has the meaning given
9to that term in Section 4 of the Illinois Gambling Act.
10    (b) A municipality within Cook County may not expend any
11funds relating to a land-based casino, including, but not
12limited to, legal fees or engineering costs, without approval
13by the electors of the municipality after a referendum.
14    (c) A municipality making an expenditure under subsection
15(b) shall report annually to the Comptroller all expenditures
16of the municipality related to a land-based casino.
17    (d) A home rule municipality within Cook County may not
18regulate expenditures related to a land-based casino in a
19manner inconsistent with this Section. This Section is a
20limitation under subsection (i) of Section 6 of Article VII of
21the Illinois Constitution on the concurrent exercise by home
22rule units of powers and functions exercised by the State.

1    Section 99. Effective date. This Act takes effect upon
2becoming law.
