AMENDMENT TO HOUSE BILL 3152

2    AMENDMENT NO. ______. Amend House Bill 3152 on page 15, by
3replacing lines 15 through 24 with the following:
4    "(b-15) Beginning in 2022, without obtaining any approvals
5from the Commission or any other agency, regardless of whether
6any such approval would otherwise be required, each
7participating utility shall pay the following amounts, as
8applicable, to the energy low-income and support program, which
9is intended to fund customer assistance programs with the
10primary purpose being avoidance of imminent disconnection and
11reconnecting customers who have been disconnected for
12nonpayment. A participating utility other than a combination
13utility shall pay $10,000,000 per year for 10 years, and a
14participating utility that is a combination utility shall pay
15$1,000,000 per year for 10 years. Such"; and
 
16on page 19, by replacing lines 8 through 13 with "law. To

1by deleting line 17 on page 27 through line 7 on page 28; and
 
2on page 43, line 2, by deleting "this"; and
 
3by replacing line 9 on page 46 through line 8 on page 47 with
4the following:
 
5    "(h) By December 31, 2017, the Commission shall prepare and
6file with the General Assembly a report on the infrastructure
7program and the performance-based formula rate. The report
8shall include the change in the average amount per kilowatthour
9paid by residential customers between June 1, 2011 and May 31,
102017. If the change in the total average rate paid exceeds 2.5%
11compounded annually, the Commission shall include in the report
12an analysis that shows the portion of the change due to the
13delivery services component and the portion of the change due
14to the supply component of the rate. The report shall include
15separate sections for each participating utility.
16    Sections 16-108.5, 16-108.6, 16-108.7, and 16-108.8 of
17this Act, other than this subsection (h), are inoperative after
18December 31, 2032 2022 for every participating utility, after
19which time a participating utility shall no longer be eligible
20to annually update the performance-based formula rate tariff
21pursuant to subsection (d) of this Section. At such time, the
22then current rates shall remain in effect until such time as

1new rates are set pursuant to Article IX of this Act, subject
2to retroactive adjustment, with interest, to reconcile rates
3charged with actual costs.
4    The fact that this Section becomes inoperative as set forth
5in this subsection shall not be construed to mean that the
6Commission may reexamine or otherwise reopen prudence or
7reasonableness determinations already made.".
