    Amends the Nuclear Safety Law of 2004. Provides that subject to appropriation (currently, not subject to appropriation), the Illinois Emergency Management Agency shall study specified items in the formulation of State nuclear power policy. Repeals the Illinois Construction Evaluation Act. Amends the Illinois Criminal Justice Information Act. Repeals Sections concerning the Custodial Interview Pilot Program and grants for electronic recording equipment. Amends the School Code. Repeals a Section concerning full year feasibility study, grants, and transitional expenditure reimbursements. Amends the Board of Higher Education Act. Repeals a Section concerning the graduation incentive grant program. Makes conforming changes. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    (20 ILCS 3015/Act rep.)
5    Section 5. The Illinois Construction Evaluation Act is
6repealed.
 
7    Section 10. The Nuclear Safety Law of 2004 is amended by
8changing Section 75 as follows:
 
9    (20 ILCS 3310/75)
10    Sec. 75. State nuclear power policy. Subject to
11appropriation, the The Illinois Emergency Management Agency,
12in cooperation with the Department of Natural Resources, shall
13study (i) the impact and cost of nuclear power and compare
14these to the impact and cost of alternative sources of energy,
15(ii) the potential effects on the public health and safety of
16all radioactive emissions from nuclear power plants, and (iii)
17all other factors that bear on the use of nuclear power or on
18nuclear safety. The Illinois Emergency Management Agency shall
19formulate a general nuclear policy for the State based on the
20findings of the study. The policy shall include but not be
21limited to the feasibility of continued use of nuclear power,
22effects of the use of nuclear power on the public health and

1safety, minimum acceptable standards for the location of any
2future nuclear power plants, and rules and regulations for the
3reporting by public utilities of radioactive emissions from
4power plants. The Illinois Emergency Management Agency shall
5establish a reliable system for communication between the
6public and the Illinois Emergency Management Agency and for
7dissemination of information by the Illinois Emergency
8Management Agency. The Illinois Emergency Management Agency
9shall publicize the findings of all studies and make the
10publications reasonably available to the public.

14    Section 15. The Illinois Criminal Justice Information Act
15is amended by repealing Sections 7.2 and 7.5.
 
16    Section 20. The Illinois Procurement Code is amended by
17changing Sections 30-45 and 33-50 as follows:

19    Sec. 30-45. Other Acts. This Article is subject to
20applicable provisions of the following Acts:
21        (1) the Prevailing Wage Act;
22        (2) the Public Construction Bond Act;
23        (3) the Public Works Employment Discrimination Act;

1        (4) the Public Works Preference Act (repealed on June
2    16, 2010 by Public Act 96-929);
3        (5) the Employment of Illinois Workers on Public Works
4    Act;
5        (6) the Public Contract Fraud Act;
6        (7) (blank); and the Illinois Construction Evaluation
7    Act; and
8        (8) the Project Labor Agreements Act.

11    Sec. 33-50. Duties of construction manager; additional
12requirements for persons performing construction work.
13    (a) Upon the award of a construction management services
14contract, a construction manager must contract with the Board
15to furnish his or her skill and judgment in cooperation with,
16and reliance upon, the services of the project architect or
17engineer. The construction manager must furnish business
18administration, management of the construction process, and
19other specified services to the Board and must perform his or
20her obligations in an expeditious and economical manner
21consistent with the interest of the Board. If it is in the
22State's best interest, the construction manager may provide or
23perform basic services for which reimbursement is provided in
24the general conditions to the construction management services
25contract.

1    (b) The actual construction work on the project must be
2awarded to contractors under this Code. The Capital Development
3Board may further separate additional divisions of work under
4this Article. This subsection is subject to the applicable
5provisions of the following Acts:
6        (1) the Prevailing Wage Act;
7        (2) the Public Construction Bond Act;
8        (3) the Public Works Employment Discrimination Act;
9        (4) the Public Works Preference Act (repealed on June
10    16, 2010 by Public Act 96-929);
11        (5) the Employment of Illinois Workers on Public Works
12    Act;
13        (6) the Public Contract Fraud Act;
14        (7) (blank); and the Illinois Construction Evaluation
15    Act; and
16        (8) the Illinois Architecture Practice Act of 1989, the
17    Professional Engineering Practice Act of 1989, the
18    Illinois Professional Land Surveyor Act of 1989, and the
19    Structural Engineering Practice Act of 1989.

22    Section 25. The School Code is amended by repealing Section
2334-21.4.

1    Section 30. The Board of Higher Education Act is amended by
2repealing Section 9.28.
 
3    Section 99. Effective date. This Act takes effect upon
