AMENDMENT TO HOUSE BILL 2924

2    AMENDMENT NO. ______. Amend House Bill 2924 on page 1, line
310, by replacing "under the authority of" with "receiving
4funding from"; and
 
5on page 3, immediately below line 26, by inserting the
6following:
 
7    "Section 10. The Department of Commerce and Economic
8Opportunity Law of the Civil Administrative Code of Illinois is
9amended by adding Section 605-1030 as follows:
 
10    (20 ILCS 605/605-1030 new)
11    Sec. 605-1030. Office of Minority Economic Empowerment.
12    (a) The Office of Minority Economic Empowerment (the
13Office) is hereby created within the Department. The Office
14shall assist minority-owned businesses, women-owned
15businesses, veteran-owned businesses, and businesses owned by

1persons with disabilities through targeted programs,
2resources, and outreach and promotional activities. The Office
3shall engage in or conduct the following activities:
4        (1) promoting and conducting outreach efforts with
5    respect of the making of small business loans pursuant to
6    Section 9-4.3 of the Build Illinois Act, and assisting
7    minority-owned businesses, women-owned businesses,
8    veteran-owned businesses, and businesses owned by persons
9    with disabilities in applying for and receiving loan funds
10    under that Act;
11        (2) providing and hosting workshops and public forums
12    and engaging in outreach efforts for minority-owned
13    businesses, women-owned businesses, veteran-owned
14    businesses, and businesses owned by persons with
15    disabilities to encourage participation in programs under
16    the Business Enterprise for Minorities, Women, and Persons
17    with Disabilities Act, and assisting those enterprises in
18    becoming designated under that Act;
19        (3) providing and hosting workshops and public forums
20    and engaging in outreach efforts that assist and educate
21    minority-owned businesses, women-owned businesses,
22    veteran-owned businesses, and businesses owned by persons
23    with disabilities on the process of applying for and
24    becoming certified to apply for State grant funds under the
25    Grant Accountability and Transparency Act;
26        (4) providing and hosting workshops and public forums

1    and engaging in outreach efforts that assist and educate
2    aspiring and existing minority-owned businesses,
3    women-owned businesses, veteran-owned businesses, and
4    businesses owned by persons with disabilities with
5    understanding concepts such as, but not limited to,
6    business formation, business planning, capital access, and
7    marketing a business;
8        (5) administering programs established by the
9    Department or the General Assembly to provide grants to
10    minority-owned business, woman-owned businesses,
11    veteran-owned businesses, and businesses owned by persons
12    with disabilities;
13        (6) coordinating assistance for businesses with other
14    State agencies;
15        (7) providing staff, administration, and related
16    support required to administer this Section; and
17        (8) establishing applications, notifications,
18    contracts, and other forms and procedures, and adopting
19    rules deemed necessary and appropriate.
20    The Office may use vendors or contract work to carry out
21the purposes of this Act.
22    (b) In order to facilitate and encourage the growth of
23supplier diversity, the Office may have at least one employee
24who serves as a supplier diversity program manager to: (i)
25collect reports and information concerning entities that
26manage supplier diversity programs; and (ii) conduct public

1workshops focused on specific industries to collaboratively
2connect diverse enterprises with entities that manage supplier
3diversity programs. The workshops shall be modeled after
4Illinois Commerce Commission hearings for utilities and
5railroads and shall include a collaborative discussion of filed
6supplier diversity reports. The program manager shall hold
7public workshops for relevant industries including, but not
8limited to, gaming, hospitals, public and private higher
9education, Economic Development for a Growing Economy tax
10credits, museums, and professional sports teams. In addition,
11the Department shall compile and publish on its website a
12master database for all points of contract for supplier
13diversity programs, including certifications accepted and
14links to the most recent supplier diversity reports submitted
15under:
16        (1) Section 405-530 of the Department of Central
17    Management Services Law of the Civil Administrative Code of
18    Illinois;
19        (2) Section 5.3 of the Illinois Health Facilities
20    Planning Act;
21        (3) Section 8k of the Business Enterprise for
22    Minorities, Women, and Persons with Disabilities Act;
23        (4) Section 5-57 of the Economic Development for a
24    Growing Economy Tax Credit Act;
25        (5) Section 5-117 of the Public Utilities Act;
26        (6) Section 12.2 of the Illinois Horse Racing Act of

1    1975; or
2        (7) Section 10 of the Railroad Supplier Diversity Act.
3    (c) For the purposes of this Section:
4    "Minority-owned business", "women-owned business", and
5"business owned by a person with a disability" have the
6meanings provided under the Business Enterprise for
7Minorities, Women, and Persons with Disabilities Act.
8    "Veteran-owned business" means a business which is at least
951% owned by one or more veterans, or, in the case of a
10corporation, at least 51% of the stock in which is owned by one
11or more veterans, and the management and daily business
12operations of which are controlled by one or more of the
13veterans who own it.
 
14    Section 15. The Economic Development for a Growing Economy
15Tax Credit Act is amended by changing Section 5-57 as follows:
 
16    (35 ILCS 10/5-57)
17    Sec. 5-57. Diversity policy Supplier diversity goals;
18reports.
19    (a) Each taxpayer claiming a credit under this Act shall,
20no later than April 15 of each taxable year for which the
21taxpayer claims a credit under this Act, submit to the
22Department of Commerce and Economic Opportunity an annual
23report containing the information described in subsections
24(b), (c), (d), and (e) of Section 5-117 of the Public Utilities

1Act. Those reports shall be submitted in the form and manner
2required by the Department of Commerce and Economic
3Opportunity.
4     (b) Any taxpayer seeking to claim a credit under this Act
5that fails to timely submit the required report shall not
6receive a credit for that taxable year unless and until such
7report is finalized and submitted to the Department. This
8subsection shall apply only to actual spending, per vendor on
9an annualized basis, that exceeds $10,000 or 10% of the
10taxpayer's vendor spending, whichever is less.
11    (c) Each taxpayer claiming a credit under this Act shall,
12no later than April 15 of each taxable year for which the
13taxpayer claims a credit under this Act, submit to the
14Department an annual report detailing the diversity of the
15taxpayer's own workforce, including full-time and part-time
16employees, contractors, and board members. The report shall be
17submitted in the form and manner required by the Department.
18Any taxpayer seeking to claim a credit under this Act that
19fails to timely submit the required report shall not receive a
20credit for that taxable year unless and until such report is
21finalized and submitted to the Department.
