1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Business Enterprise for Minorities, Women,
5and Persons with Disabilities Act is amended by adding Section
68k as follows:
 
7    (30 ILCS 575/8k new)
8    Sec. 8k. Museum and sports facility diversity report.
9    (a) Beginning in Fiscal Year 2020 and every fiscal year
10thereafter, (1) any museum under the authority of a park
11district in a municipality having a population of 1,000,000 or
12more and (2) any sports facility under the jurisdiction of the
13Illinois Sports Facilities Authority shall submit an annual
14diversity report to the Council, on or before January 30, which
15includes information and data on diversity goals, and progress
16toward achieving those goals, by businesses owned by
17minorities, women, and persons with disabilities.
18    (b) The diversity report shall include the following
19information from the previous fiscal year:
20        (1) the percentage of total annual spending on
21    contracts with businesses owned by minorities, women, and
22    persons with disabilities;
23        (2) the total number of contracts awarded or let to

1    businesses owned by minorities, women, and persons with
2    disabilities;
3        (3) the type of professional service contracts awarded
4    or let to business owned by minorities, women, and persons
5    with disabilities, including, but not limited to,
6    construction management, media, accounting, marketing, and
7    public relations contracts;
8        (4) whether the business owned by minorities, women, or
9    persons with disabilities is the primary entity holding the
10    contract with the museum or sports facility or a
11    subcontractor on a larger contract with the museum or
12    sports facility;
13        (5) a narrative description of contracting diversity
14    and equity goals and strategic plans for meeting those
15    goals;
16        (6) the percentage of total annual spending in
17    professional services with businesses owned by minorities,
18    women, and persons with disabilities, including, but not
19    limited to, the following professional services
20    categories: (A) accounting; (B) architecture and
21    engineering; (C) consulting; (D) information technology;
22    (E) insurance; (F) financial, legal, media, construction
23    management, and marketing services; and (G) other
24    professional services; and
25        (7) when reporting on businesses owned by minorities,
26    the report shall include a breakdown by demographic group.

1    The reports shall be submitted in the format as prescribed
2by the Council by rule. The Council shall publish each annual
3report on its website. In November of each year, the Council
4shall transmit to the General Assembly a report including a
5summary of the information reported to the Council for the
6previous fiscal year and a cumulative summary for all previous
7years in which reports were filed.
8    (c) Museums having to report under this Section shall hold
9an annual symposium beginning on or before July 30, 2020, and
10every year thereafter, that is open to the public on the status
11of contracting diversity and equity goals, and to share best
12practices and to collaboratively seek solutions to structural
13impediments that preclude achieving those goals. Museums may
14hold this symposium together or separately.
15    (d) Sports facilities having to report under this Section
16shall hold an annual symposium beginning on or before July 30,
172020, and every year thereafter, that is open to the public on
18the status of contracting diversity and equity goals, and to
19share best practices and to collaboratively seek solutions to
20structural impediments that preclude achieving those goals.
21Sports facilities may hold this symposium together or
22separately.
23    (e) The Council shall publish a database on its website of
24the point of contact for each museum and sports facility
25responsible for business diversity, along with a list of
26certifications each recognizes for business diversity.

1    Section 99. Effective date. This Act takes effect upon
2becoming law.
