SYNOPSIS AS INTRODUCED:
 
20 ILCS 505/5f new

    Amends the Children and Family Services Act. Provides that, for State Fiscal Year 2020, the Department of Children and Family Services shall increase reimbursement rates payable to each private agency with a purchase of service contract or grant from the Department to an amount that equals the sum of all increases in general inflation during State Fiscal Years 2014 through 2018 as determined by the consumer price index-u published by the Bureau of Labor Statistics of the United States Department of Labor, less any rate increases, previously provided by the Department. Sets forth the types of services eligible for the increased reimbursement rate, including, (i) residential services, (ii) specialized, adolescent, treatment, or other non-traditional or Home-of-Relative foster care services, and (iii) intact family services. Provides that beginning in State Fiscal Year 2020, and for every State fiscal year thereafter, the Department shall implement the rate reimbursement methodology outlined in a specified provision of the Illinois Administrative Code when calculating and determining the payment rates for private agencies that contract with the Department to provide specified services. Provides that, for State Fiscal Year 2021, and for every State fiscal year thereafter, foster parent rates and payment rates for other specified services shall be adjusted each year to an amount that equals any increase in general inflation as determined by the consumer price index-u. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Children and Family Services Act is amended
5by adding Section 5f as follows:
 
6    (20 ILCS 505/5f new)
7    Sec. 5f. Payment rate increases for reimbursable services.
8    (a) For the purposes of this Section, "consumer price
9index-u" means the index published by the Bureau of Labor
10Statistics of the United States Department of Labor that
11measures the average change in prices of goods and services
12purchased by all urban consumers, United States city average,
13all items, 1982-84 = 100.
14    (b) For State Fiscal Year 2020, the Department shall
15increase reimbursement rates payable to each private agency
16with a purchase of service contract or grant from the
17Department to an amount that equals the sum of all increases in
18general inflation during State Fiscal years 2014 through 2018
19as determined by the consumer price index-u, less any rate
20increases, previously provided by the Department. The
21contractual and grant services under this Section include the
22following:
23        (1) Residential services, including child care

1    institution, group home care, independent living services,
2    or transitional living services.
3        (2) Specialized, adolescent, treatment, or other
4    non-traditional or Home-of-Relative foster care.
5        (3) Traditional or Home-of-Relative foster care.
6        (4) Intact Family Services.
7        (5) Teen Parenting Services.
8        (6) Other supportive service grants or contracts.
9    (c) Beginning in State Fiscal Year 2020, and for every
10State fiscal year thereafter, the Department shall implement
11the rate reimbursement methodology outline in 89 Ill. Admin
12Code 356.5 (f) when calculating and determining the payment
13rates for private agencies that contract with the Department to
14provide any of the services enumerated in 89 Ill Adm. Code
15356.5(f) and in paragraph (1) of subsection (b) of this
16Section. Payment rates calculated and determined as provided in
17this Section shall include an amount equal to any increase in
18the general inflation as determined by the consumer price
19index-u.
20    For services listed under paragraphs (2) through (6) of
21subsection (b), the Department shall establish a rate model
22based on staffing and services expectations for each type of
23care within 9 months of the start of State Fiscal Year 2020.
24For State Fiscal Year 2021 and for every State fiscal year
25thereafter, the rate shall be adjusted to an amount equal to
26any increase in general inflation as determined by the consumer

2rate each year by an amount equal to any increase in general
3inflation as determined by the consumer price index-u.

5    Section 99. Effective date. This Act takes effect upon
6becoming law.
