1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Southern Illinois University Management Act
5is amended by changing Sections 2, 4, and 5 as follows:

7    Sec. 2. The Board shall consist of 7 members appointed by
8the Governor, by and with the advice and consent of the Senate,
9the Superintendent of Public Instruction, or his chief
10assistant for liaison with higher education when designated to
11serve in his place, ex-officio, and 2 one voting student
12members, one member designated by the Governor from each one
13campus of the University and one nonvoting student member from
14the campus of the University not represented by the voting
15student member. The Governor shall designate one of the student
16members serving on the Board to serve as the voting student
17member. Each student member shall be chosen by the respective
18campuses of Southern Illinois University at Carbondale and
19Edwardsville. The method of choosing these student members
20shall be by campus-wide student election, and any student
21designated by the Governor to be a voting student member shall
22be one of the students chosen by this method. The student
23members shall serve terms of one year beginning on July 1 of

1each year, except that the student members initially selected
2shall serve a term beginning on the date of such selection and
3expiring on the next succeeding June 30. To be eligible for
4selection as a student member and to be eligible to remain as a
5voting or nonvoting student member of the Board, a student
6member must be a resident of this State, must have and maintain
7a grade point average that is equivalent to at least 2.5 on a
84.0 scale, and must be a full-time full time student enrolled
9at all times during his or her term of office except for that
10part of the term which follows the completion of the last full
11regular semester of an academic year and precedes the first
12full regular semester of the succeeding academic year at the
13university (sometimes commonly referred to as the summer
14session or summer school). If a voting or nonvoting student
15member serving on the Board fails to continue to meet or
16maintain the residency, minimum grade point average, or
17enrollment requirement established by this Section, his or her
18membership on the Board shall be deemed to have terminated by
19operation of law. No more than 4 of the members appointed by
20the Governor shall be affiliated with the same political party.
21Each member appointed by the Governor must be a resident of
22this State. A failure to meet or maintain this residency
23requirement constitutes a resignation from and creates a
24vacancy in the Board. Upon the expiration of the terms of
25members appointed by the Governor, their respective successors
26shall be appointed for terms of 6 years from the third Monday

1in January of each odd-numbered year and until their respective
2successors are appointed for like terms. If the Senate is not
3in session appointments shall be made as in the case of
4vacancies.

8    Sec. 4. Members of the Board shall serve without
9compensation but shall be entitled to reasonable amounts for
10expenses necessarily incurred in the performance of their
11duties. Such expenses incurred by any non-voting student member
12may, at the discretion of the Chairman of the Board, be
13provided for by advance payment to such member, who shall
14account therefor to the Board immediately after each meeting.
15    No member of the Board shall hold or be employed in or
16appointed to any office or place under the authority of the
17Board, nor shall any member of the Board be directly or
18indirectly interested in any contract made by the Board, nor
19shall he be an employee of the State Government. This section
20does not prohibit the student members of the Board from
21maintaining normal and official status as enrolled students or
22normal student employment at Southern Illinois University.

1    Sec. 5. Members of the Board shall elect annually by secret
2ballot from their own number a chairman who shall preside over
3meetings of the Board and a secretary.
4    Meetings of the Board shall be held at least once each
5quarter on a campus of Southern Illinois University. At all
6regular meetings of the Board, a majority of its voting members
7shall constitute a quorum. Each The student member members
8shall have all of the privileges of membership, including the
9right to make and second motions and to attend executive
10sessions and , other than the right to vote, except that the
11student member designated by the Governor as the voting student
12member shall have the right to vote on all Board matters except
13those involving faculty tenure, faculty promotion, or any issue
14on which the student member has a direct conflict of interest.
15For the purposes of this Section, a student member shall not be
16deemed to have a direct conflict of interest in and may vote on
17any item involving the employment or compensation of the
18Chancellor at any campus or the President of the University or
19the election of officers. A student member who is not entitled
20to vote on a measure at a meeting of the Board or any of its
21committees shall not be considered a member for the purpose of
22determining whether a quorum is present at the time that
23measure is voted upon. No action of the Board shall be
24invalidated by reason of any vacancies on the Board, or by
25reason of any failure to select a student member.
26    Special meetings of the Board may be called by the chairman

1of the Board or by any 3 members of the Board.
2    At each regular and special meeting that is open to the
3public, members of the public and employees of the University
4shall be afforded time, subject to reasonable constraints, to
5make comments to or ask questions of the Board.
