AMENDMENT TO HOUSE BILL 837

2    AMENDMENT NO. ______. Amend House Bill 837 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Short title. This Act may be cited as the
5Illinois Legislative Youth Advisory Council Act.
 
6    Section 5. Definition. For purposes of this Act:
7    "Council" means the Illinois Legislative Youth Advisory
8Council.
 
9    Section 10. The Illinois Legislative Youth Advisory
10Council. For the purpose of facilitating communication between
11the youth of the State of Illinois and the elected branches of
12State government regarding the issues, interests, and needs
13important to youth in the State of Illinois, the Illinois
14Legislative Youth Advisory Council is created. The Council
15shall have the powers and responsibilities enumerated in this

1Act, together with such others as may be conferred upon it by
2law. The Council shall be an entity created under the
3legislative branch, and maintained and staffed under the
4executive branch by the Office of the Governor or an agency
5designated by the Governor that is under the jurisdiction of
6the Governor.
 
7    Section 15. Advisory Board; members; nomination; term of
8office; vacancies.
9    (a) An Advisory Board shall be created to facilitate the
10functions of the Council. The Advisory Board shall consist of 2
11members of the House of Representatives, one each appointed by
12the Speaker of the House of Representatives and the Minority
13Leader of the House of Representatives; and 2 members of the
14Senate, one each appointed by the President of the Senate and
15the Minority Leader of the Senate. The initial term for members
16of the Advisory Council shall begin on January l, 2020, or the
17effective date of this Act, whichever occurs later, and expire
18on January 11, 2022. Thereafter, the term for members of the
19Advisory Council shall begin on the Thursday following the
20second Wednesday of January, and expire after 2 years. On or
21before September 1, 2019, the Advisory Board shall create an
22application that shall be used in nominating individuals to be
23members of the Council. The Advisory Board may, from time to
24time, modify the application with the consent of the Council.
25While the Council is in session, the Advisory Board may attend

1meetings of the Council, and may generally advise the Council.
2Nothing in this Act shall be construed to entitle Advisory
3Board members to vote on matters pending before the Council.
4    (b) Each member of the House of Representatives shall
5nominate one qualified individual that resides in the
6Representative's legislative district to serve as a member of
7the Council after receiving and reviewing the individual's
8application and considering any recommendation made by a member
9of the Senate. The Representative shall make the nomination on
10or before October 31 of each calendar year. After making the
11nomination, the Representative shall, by first class mail,
12notify the nominated individual by November 15 of the same
13year. If the Representative is a member of the majority party,
14the Representative shall notify the Speaker of the House of
15Representatives of his or her nomination by November 15 of the
16same year. If the Representative is a member of the minority
17party, the Representative shall notify the Minority Leader of
18the House of Representatives of his or her nomination by
19November 15 of the same year.
20    (c) Upon receiving a nomination, the Speaker of the House
21of Representatives or the Minority Leader of the House of
22Representatives, whichever the case may be, shall accept the
23nomination, except for good cause shown, and appoint the
24individual to be a member of the Council. Upon appointing the
25nominated individual, the Speaker of the House of
26Representatives or the Minority Leader of the House of

1Representatives, whichever the case may be, shall notify the
2individual of his or her appointment by first class mail. A
3nomination shall not be rejected except for good cause shown.
4If a nomination is rejected, the Speaker of the House of
5Representatives or the Minority Leader of the House of
6Representatives, whichever the case may be, shall state in
7writing the reason or reasons that the nomination was rejected,
8and transmit the written rejection to the nominated individual
9and the Senator that nominated the individual. In such a case,
10the Senator shall nominate another qualified individual within
115 days.
12    (d) Each Council member's term shall be for one year. A
13member shall be allowed to serve more than one term, so long as
14the member continues to meet the requirements for being a
15member and is appointed for each term.
16    (e) Any vacancies in the Council shall be filled in the
17same or substantially the same manner as the original
18appointment within 30 days after the vacancy.
 
19    Section 20. Members; qualifications. Each member of the
20Council shall, during his or her term, be:
21        (1) a resident of this State;
22        (2) older than 16 years of age and younger than 22
23    years of age, except that if a member turns 23 years of age
24    during his or her term, such member shall be allowed to
25    complete the term; and

1        (3) be a student enrolled at a high school, community
2    college, or university in this State, except that if a
3    member graduates from high school or college during his or
4    her term, such member shall be allowed to complete the
5    term.
 
6    Section 25. Quorum; meetings; committees; leadership
7responsibilities.
8    (a) A majority of those appointed to the Council shall
9constitute a quorum.
10    (b) The Council shall convene each year on the Saturday
11following the second Wednesday of January in the State Capitol,
12unless the General Assembly is in session. An alternative
13meeting place shall be selected if one or both chambers cannot
14accommodate the meeting. At the initial meeting, the Council
15shall:
16        (1) elect a President, Secretary, Treasurer, and
17    Clerk;
18        (2) adopt rules of procedure;
19        (3) form committees to assist in furthering the goals
20    of the Council, and appoint committee chairs and
21    vice-chairs; and
22        (4) announce the date and location of the next meeting
23    of the Council.
24    (c) The Council shall meet as often as is deemed necessary.
25For all other meetings and committee meetings, the Council may

1meet by electronic or telephonic means. Members of the Council
2shall be excused from school to participate in in-person
3meetings of the Council.
4    (d) The President of the Council shall:
5        (1) convene, direct, and adjourn meetings of the
6    Council;
7        (2) call for a vote on any matter pending before the
8    Council;
9        (3) transmit Council reports to the General Assembly;
10    and
11        (4) be the official liaison between the Council and
12    General Assembly.
13    (e) The Secretary of the Council shall:
14        (1) serve as Acting President in the President's
15    absence;
16        (2) prepare and distribute agendas of Council meetings
17    to Council members; and
18        (3) keep and maintain the minutes of Council meetings.
19    (f) The Treasurer of the Council shall:
20        (1) report on the funds available in the Illinois
21    Legislative Youth Advisory Council Fund; and
22        (2) serve as the official liaison between the Council
23    and the State Treasurer and the State Comptroller.
24    (g) The Clerk of the Council shall:
25        (1) record the final votes on any measure called for a
26    vote by the President; and

1        (2) transmit the final vote on all measures called for
2    a vote by the President to the Secretary for inclusion in
3    the minutes.
4    (h) The President in transition shall be appointed by the
5President of the Senate within 14 days after the effective date
6of this Act. The President in transition shall meet the
7qualifications set forth in Section 20 of this Act, and shall
8serve until the second Wednesday of the January following the
9effective date of this Act. The President in transition shall
10be responsible for initial outreach and marketing of the
11Council to the youth of Illinois. The President in transition
12may use the provisions of Section 35 of this Act to facilitate
13these duties.
14    (i) The Council may create more leadership positions by
15rule.
 
16    Section 30. Powers. The Council may:
17        (1) request the drafting of legislative measures from
18    the Legislative Reference Bureau;
19        (2) provide testimony during any committee meeting of
20    the General Assembly;
21        (3) vote on any matter pending before the General
22    Assembly and inform the General Assembly of the Council's
23    position on the matter;
24        (4) draft reports and advisory opinions to the General
25    Assembly;

1        (5) perform any other activity that may reasonably
2    inform the General Assembly of the Council's position on
3    any issue of relevance; and
4        (6) conduct periodic seminars for members of the
5    Council concerning leadership, government, and the General
6    Assembly.
 
7    Section 35. Outreach.
8    (a) On or before September 1 of each year, the President of
9the Council shall notify all high schools, colleges, and
10universities in this State that the time for applying to become
11a member of the Council is open, and shall expire on October
1231. The notice shall include the requirements for membership, a
13copy of the application, and the name, district address, and
14district phone number of the Senators near the high school,
15college, or university.
16    (b) Upon receiving notice that the application period is
17open, the high school, college, or university shall make
18reasonable attempts to notify interested students of the
19Council.
20    (c) To raise awareness about the Council, the Council may:
21        (1) conduct a public awareness campaign;
22        (2) maintain a website; and
23        (3) work with established youth groups to increase
24    awareness.

1    Section 40. Staff support. Staff and administrative
2support for the Council shall be provided by the Office of the
3Governor or an agency designated by the Governor that is under
4the jurisdiction of the Governor. Staff members shall be
5uncompensated and shall assist the Council in administrative
6duties.
 
7    Section 45. Report to the General Assembly and Governor.
8The Council shall submit an annual report electronically to the
9General Assembly and the Governor detailing its activities and
10recommending any proposed legislation.
 
11    Section 50. Illinois Legislative Youth Advisory Council
12Fund. The Illinois Legislative Youth Advisory Council Fund is
13created as a special fund in the State treasury. All moneys in
14the Fund shall be used to reimburse Council members for actual
15expenses incurred in traveling to Council meetings, including
16travel, food, and lodging, and printing the annual report in
17compliance with Section 45 of this Act. The moneys in the
18Illinois Legislative Youth Advisory Council Fund are subject to
19appropriation by the General Assembly. The Illinois
20Legislative Youth Advisory Council Fund may accept donations
21and gifts.
 
22    Section 95. The State Finance Act is amended by adding
23Section 5.891 as follows:

2    Sec. 5.891. The Illinois Legislative Youth Advisory
3Council Fund.
 
4    Section 99. Effective date. This Act takes effect upon
5becoming law.".
