    Amends the Prevention of Cigarette Sales to Minors Act. Makes a technical change in a Section concerning statements for delivery sales.

1    AN ACT concerning criminal law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Prevention of Cigarette Sales to Minors Act
5is amended by changing Section 9 as follows:
 
6    (720 ILCS 678/9)
7    Sec. 9. Statements for delivery sales.
8    (a) Each person who makes a delivery sale shall collect and
9and remit to the Department all excise taxes imposed by this
10State with respect to such delivery sale and maintain evidence
11of such payment unless the person is located outside the State
12and includes a statement on the outside of the shipping package
13stating: "Illinois law requires the payment of state taxes on
14this shipment of cigarettes. You are legally responsible for
15all applicable unpaid state taxes on these cigarettes."
16    (b) A statement meets the requirements of subsection (a) if
17the statement is:
18        (1) clear and conspicuous;
19        (2) contained in a printed box set apart from the
20    shipping label and other markings contained on the shipping
21    package;
22        (3) printed in bold, capital letters;
23        (4) printed with a degree of color contrast between the

1    background and the printed statement that is no less than
2    the color contrast between the background and the largest
3    text used on the shipping label; and
4        (5) located on the same side of the shipping package as
5    the shipping label.
