AMENDMENT TO SENATE BILL 2808

2    AMENDMENT NO. ______. Amend Senate Bill 2808 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Alzheimer's Disease and Related Dementias
5Services Act is amended by changing Sections 15, 30, and 35 as
6follows:
 
7    (410 ILCS 406/15)
8    (For Act repeal see Section 90)
9    Sec. 15. Applicability. Programs covered by this Act
10include, but are not limited to, health care facilities
11licensed or certified by the Assisted Living and Shared Housing
12Act; Life Care Facilities Act; Nursing Home Care Act;
13Specialized Mental Health Rehabilitation Act of 2013; Home
14Health, Home Services, and Home Nursing Agency Licensing Act;
15and Hospice Program Licensing Act; and End Stage Renal Disease
16Facility Act. This Act does not apply to physicians licensed to

1practice medicine in all its branches.

4    (For Act repeal see Section 90)
5    Sec. 30. Staff training.
6    (a) Staff with direct access to clients with Alzheimer's
7disease or a related dementia hired prior to the adoption of
8rules implementing this Act shall receive a minimum of 6 hours
9of initial training within 90 days after the effective date of
10this Act using an Alzheimer's disease and related dementias
11services curriculum compiled certified by the Department,
12except as provided in subsection (c).
13    (b) Staff with direct access to clients with Alzheimer's
14disease or a related dementia hired after the adoption of rules
15implementing this Act shall complete a minimum of 6 hours of
16initial training in the first 60 days of employment using an
17Alzheimer's disease and related dementias services curriculum
18compiled certified by the Department, except as provided in
19subsection (c).
20    (c) Subsections (a) and (b) shall not apply to the
21following:
22        (1) staff who received at least 6 hours of comparable
23    training in compliance with licensure or certified
24    training requirements; and
25        (2) staff temporarily hired or temporarily detailed by

1    a facility licensed under the Nursing Home Care Act to
2    permit the facility to meet statutory staffing
3    requirements.
4    (d) An Alzheimer's disease and related dementias services
5curriculum compiled certified by the Department and published
6on the Department's website must include at a minimum the
7following topics: understanding dementia, effectively
8communicating with individuals with dementia, assisting
9individuals with dementia in performing activities of daily
10living, problem solving with individuals with dementia who
11exhibit challenging behavior, fundamentals of dementia care,
12safe environments, and managing the activities of individuals
13with dementia.
14    (e) An individual who received training consistent with the
15requirements of this Section while employed by another program
16or through an educational institution or an individual with 3
17or more years of experience working with Alzheimer's disease
18and related dementias services may petition the Department for
19a waiver of the initial training requirements set forth in this
20Section. The Department shall evaluate each request on a case
21by case basis.
22    (f) Upon the adoption of rules implementing this Act, staff
23with direct access to clients with dementia shall receive 3
24hours of advanced training on caring for individuals with
25Alzheimer's disease and related dementias each year.
26    (g) Upon the adoption of rules implementing this Act,

1Alzheimer's disease and related dementias services program
2employers shall maintain training records and make them
3available to the Department on request.

7    Sec. 35. Supervisor of services Program director. Upon the
8adoption of rules implementing this Act, in addition to the
9training required under Section 30 of this Act, a manager,
10supervisor, or person with the chief responsibility of
11oversight of the director of an Alzheimer's disease and related
12dementias services within an entity program shall complete an
13Alzheimer's disease and related dementias services curriculum
14from a list compiled by the Department or have 5 years of
15experience as a director of an Alzheimer's disease and related
16dementias services program.
