1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Alzheimer's Disease and Related Dementias
5Services Act is amended by changing Sections 15, 30, and 35 as
6follows:

8    (For Act repeal see Section 90)
9    Sec. 15. Applicability. Programs covered by this Act
10include, but are not limited to, health care facilities
11licensed or certified by the Assisted Living and Shared Housing
12Act; Life Care Facilities Act; Nursing Home Care Act;
13Specialized Mental Health Rehabilitation Act of 2013; Home
14Health, Home Services, and Home Nursing Agency Licensing Act;
15and Hospice Program Licensing Act; and End Stage Renal Disease
16Facility Act. This Act does not apply to physicians licensed to
17practice medicine in all its branches.

21    Sec. 30. Staff training.
22    (a) (Blank). Staff with direct access to clients with

1Alzheimer's disease or a related dementia hired prior to the
2adoption of rules implementing this Act shall receive a minimum
3of 6 hours of initial training within 90 days after the
4effective date of this Act using Alzheimer's disease and
5related dementias services certified by the Department, except
6as provided in subsection (c).
7    (b) Staff with direct access to clients with Alzheimer's
8disease or a related dementia hired after the adoption of rules
9implementing this Act shall complete a minimum of 6 hours of
10initial training in the first 60 days of employment using an
11Alzheimer's disease and related dementias services curriculum
12compiled certified by the Department, except as provided in
13subsection (c).
14    (c) Subsection Subsections (a) and (b) shall not apply to
15the following:
16        (1) staff who received at least 6 hours of comparable
17    training in compliance with licensure or certified
18    training requirements; and
19        (2) staff temporarily hired or temporarily detailed by
20    a facility licensed under the Nursing Home Care Act to
21    permit the facility to meet statutory staffing
22    requirements.
23    (d) An Alzheimer's disease and related dementias services
24curriculum compiled certified by the Department and published
25on the Department's website must include at a minimum the
26following topics: understanding dementia, effectively

1communicating with individuals with dementia, assisting
2individuals with dementia in performing activities of daily
3living, problem solving with individuals with dementia who
4exhibit challenging behavior, fundamentals of dementia care,
5safe environments, and managing the activities of individuals
6with dementia.
7    (e) (Blank). An individual who received training
8consistent with the requirements of this Section while employed
9by another program or through an educational institution or an
10individual with 3 or more years of experience working with
11Alzheimer's disease and related dementias services may
12petition the Department for a waiver of the initial training
13requirements set forth in this Section. The Department shall
14evaluate each request on a case by case basis.
15    (f) Upon the adoption of rules implementing this Act, staff
16with direct access to clients with dementia shall receive 3
17hours of advanced training on caring for individuals with
18Alzheimer's disease and related dementias each year.
19    (g) Upon the adoption of rules implementing this Act,
20Alzheimer's disease and related dementias services program
21employers shall maintain training records and make them
22available to the Department on request.

1    Sec. 35. Supervisor of services Program director. Upon the
2adoption of rules implementing this Act, in addition to the
3training required under Section 30 of this Act, a manager,
4supervisor, or person with the chief responsibility of
5oversight of the director of an Alzheimer's disease and related
6dementias services within an entity program shall complete an
7Alzheimer's disease and related dementias services curriculum
8from a list compiled by the Department or have 5 years of
9experience as a director of an Alzheimer's disease and related
10dementias services program.
