AMENDMENT TO SENATE BILL 2806

2    AMENDMENT NO. ______. Amend Senate Bill 2806 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Rivers, Lakes, and Streams Act is amended
5by changing Section 30 as follows:
 
6    (615 ILCS 5/30)  (from Ch. 19, par. 78.1)
7    Sec. 30. Powers of the Department of Natural Resources.
8    (a) The Department of Natural Resources may make such
9reasonable rules and regulations as may be necessary to
10administer this Act.
11    (b) Notwithstanding any provision of this Act, the
12Department of Natural Resources does not have the power to
13adopt rules or regulations, or to issue or deny permits, with
14respect to use or construction on private waterfront property
15on land exposed due to reliction in rivers located wholly or
16partly within this State.

1    For purposes of this Section, "private waterfront
2property" means land bordering or including any public river of
3this State in which a plot of land is owned by a private
4citizen and his or her plot shows the boundaries of his or her
5property extends into the public river and which is used for
6the purposes of calculating the value of property taxes paid on
7the property.
8    For the purposes of this Section, "reliction" means the
9gradual recession of water leaving land permanently uncovered.
