AMENDMENT TO SENATE BILL 2803

2    AMENDMENT NO. ______. Amend Senate Bill 2803 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Vehicle Code is amended by
5changing Section 11-500 as follows:
 
6    (625 ILCS 5/11-500)  (from Ch. 95 1/2, par. 11-500)
7    Sec. 11-500. Definitions. For the purposes of interpreting
8Sections 6-206.1 and 6-208.1 of this Code, "first offender"
9shall mean any person who has not had a previous conviction or
10court assigned supervision for violating Section 11-501, or a
11similar provision of a local ordinance, or a conviction in any
12other state for a violation of driving while under the
13influence or a similar offense where the cause of action is the
14same or substantially similar to this Code or similar offenses
15committed on a military installation, or any person who has not
16had a driver's license suspension pursuant to paragraph 6 of

1subsection (a) of Section 6-206 as the result of refusal of
2chemical testing in another state, or any person who has not
3had a driver's license suspension or revocation for violating
4Section 11-501.1 within 15 5 years prior to the date of the
5current offense, except in cases where the driver submitted to
6chemical testing resulting in an alcohol concentration of 0.08
7or more, or any amount of a drug, substance, or compound in
8such person's blood, other bodily substance, or urine resulting
9from the unlawful use or consumption of cannabis listed in the
10Cannabis Control Act, a controlled substance listed in the
11Illinois Controlled Substances Act, or an intoxicating
12compound listed in the Use of Intoxicating Compounds Act, or
13methamphetamine as listed in the Methamphetamine Control and
14Community Protection Act and was subsequently found not guilty
15of violating Section 11-501, or a similar provision of a local
16ordinance.
