AMENDMENT TO SENATE BILL 2528

2    AMENDMENT NO. ______. Amend Senate Bill 2528 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Promotion Act is amended by
5changing Section 8b as follows:
 
6    (20 ILCS 665/8b)
7    Sec. 8b. Municipal convention center and sports facility
8attraction grants.
9    (a) Until July 1, 2022 July 1, 2020, the Department is
10authorized to make grants, subject to appropriation by the
11General Assembly, from the Tourism Promotion Fund to a unit of
12local government, municipal convention center, or convention
13center authority that provides incentives, as defined in
14subsection (i) of Section 3 of this Act, for the purpose of
15attracting conventions, meetings, and trade shows to municipal
16convention centers and attracting sporting events to municipal

1amateur sports facilities. Grants awarded under this Section
2shall be based on the net proceeds received under the Hotel
3Operators' Occupation Tax Act for the renting, leasing, or
4letting of hotel rooms in the municipality for the month in
5which the convention, meeting, trade show, or sporting event
6occurs. Grants shall not exceed 80% of the incentive amount
7provided by the unit of local government, municipal convention
8center, or convention center authority. Further, in no event
9may the aggregate amount of grants awarded to a single
10municipal convention center, convention center authority, or
11municipal amateur sports facility exceed $200,000 in any
12calendar year. The Department may, by rule, require any other
13provisions it deems necessary in order to protect the State's
14interest in administering this program.
15    (b) No later than May 15 of each year, through May 15,
162020, the unit of local government, municipal convention
17center, or convention center authority shall certify to the
18Department the amounts of funds expended in the previous fiscal
19year to provide qualified incentives; however, in no event may
20the certified amount pursuant to this paragraph exceed $200,000
21for any municipal convention center, convention center
22authority, or municipal amateur sports facility in any calendar
23year. The unit of local government, convention center, or
24convention center authority shall certify (A) the net proceeds
25received under the Hotel Operators' Occupation Tax Act for the
26renting, leasing, or letting of hotel rooms in the municipality

1for the month in which the convention, meeting, or trade show
2occurs and (B) the average of the net proceeds received under
3the Hotel Operators' Occupation Tax Act for the renting,
4leasing, or letting of hotel rooms in the municipality for the
5same month in the 3 immediately preceding years. The unit of
6local government, municipal convention center, or convention
7center authority shall include the incentive amounts as part of
8its regular audit.
9    (b-5) Grants awarded to a unit of local government,
10municipal convention center, or convention center authority
11may be made by the Department of Commerce and Economic
12Opportunity from appropriations for those purposes for any
13fiscal year, without regard to the fact that the qualification
14or obligation may have occurred in a prior fiscal year.
15    (c) The Department shall submit a report on the
16effectiveness of the program established under this Section to
17the General Assembly no later than January 1, 2022 January 1,
182020.
