AMENDMENT TO SENATE BILL 2518

2    AMENDMENT NO. ______. Amend Senate Bill 2518 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Vehicle Code is amended by
5changing Sections 3-506, 3-802, and 3-806.3 and by adding
6Sections 3-407.5 and 3-699.16 as follows:
 
7    (625 ILCS 5/3-407.5 new)
8    Sec. 3-407.5. Temporary permit for charitable
9not-for-profit organization.
10    (a) Any charitable not-for-profit organization that is
11exempt from federal income taxation under Section 501(c)(3) of
12the Internal Revenue Code and engaged in the maintenance and
13repair of motor vehicles may make application to the Secretary
14for a temporary permit to operate a motor vehicle that was
15donated to the not-for-profit organization for the purpose of
16donating the motor vehicle to a low-income individual.

1    (b) A permit issued under this Section shall be valid for a
2period of 90 days. No more than 2 permits may be issued under
3this Section for any one vehicle. A vehicle may be operated
4with the temporary permit only for purposes of delivering the
5vehicle to a not-for-profit organization, moving the vehicle
6for maintenance or repairs, or delivering the vehicle to a
7low-income individual.
8    (c) An applicant for the temporary permit shall provide the
9Secretary proof of the not-for-profit status of the
10organization, along with a document signed by the donor and the
11not-for-profit organization expressly stating that the vehicle
12is being donated to the not-for-profit organization by the
13donor, and the not-for-profit organization assumes all
14liability for the operation of the vehicle upon accepting the
15donation. This form must identify the vehicle by make, model,
16year, and vehicle identification number. An applicant for the
17temporary permit shall also provide the Secretary with proof of
18liability insurance covering the vehicle in at least the
19minimum amounts set forth in Article VI of Chapter 7. The
20donated motor vehicle shall meet the requirements for
21registration under Chapter 3 of this Code to qualify for a
22temporary permit under this Section. A copy of the permit shall
23be kept inside the motor vehicle at all times.
24    (d) The Secretary may adopt any rules necessary to
25implement this Section.

1    (625 ILCS 5/3-506)
2    Sec. 3-506. Transfer of plates to spouses of military
3service members. Upon the death of a military service member
4who has been issued a special plate under Section 3-609.1,
53-620, 3-621, 3-622, 3-623, 3-624, 3-625, 3-626, 3-628, 3-638,
63-642, 3-645, 3-647, 3-650, 3-651, 3-666, 3-667, 3-668, 3-669,
73-676, 3-677, 3-680, 3-681, 3-683, 3-686, 3-688, 3-693, 3-698,
8or 3-699.12, or 3-699.16 of this Code, the surviving spouse of
9that service member may retain the plate so long as that spouse
10is a resident of Illinois and transfers the registration to his
11or her name within 180 days of the death of the service member.
12    For the purposes of this Section, "service member" means
13any individual who is serving or has served in any branch of
14the United States Armed Forces, including the National Guard or
15other reserve components of the Armed Forces, and has been
16issued a special plate listed in this Section.

18    (625 ILCS 5/3-699.16 new)
19    Sec. 3-699.16. Global War on Terrorism license plates.
20    (a) In addition to any other special license plate, the
21Secretary, upon receipt of all applicable fees and applications
22made in the form prescribed by the Secretary, may issue Global
23War on Terrorism license plates to residents of this State who
24have earned the Global War on Terrorism Expeditionary Medal
25from the United States Armed Forces. The special Global War on

1Terrorism plates issued under this Section shall be affixed
2only to passenger vehicles of the first division, including
3motorcycles, or motor vehicles of the second division weighing
4not more than 8,000 pounds. Plates issued under this Section
5shall expire according to the multi-year procedure under
6Section 3-414.1 of this Code.
7    (b) The design, color, and format of the Global War on
8Terrorism license plate shall be wholly within the discretion
9of the Secretary. The Secretary may, in his or her discretion,
10allow the Global War on Terrorism license plates to be issued
11as vanity or personalized plates in accordance with Section
123-405.1 of this Code. Global War on Terrorism license plates
13are not required to designate "Land of Lincoln", as prescribed
14in subsection (b) of Section 3-412 of this Code. The Secretary
15shall, in his or her discretion, approve and prescribe stickers
16or decals as provided under Section 3-412.

18    Sec. 3-802. Reclassifications and upgrades.
19    (a) Definitions. For the purposes of this Section, the
20following words shall have the meanings ascribed to them as
21follows:
22        "Reclassification" means changing the registration of
23    a vehicle from one plate category to another.
24        "Upgrade" means increasing the registered weight of a
25    vehicle within the same plate category.

1    (b) When reclassing the registration of a vehicle from one
2plate category to another, the owner shall receive credit for
3the unused portion of the present plate and be charged the
4current portion fees for the new plate. In addition, the
5appropriate replacement plate and replacement sticker fees
6shall be assessed.
7    (b-5) Beginning with the 2019 registration year, any
8individual who has a registration issued under either Section
93-405 or 3-405.1 that qualifies for a special license plate
10under Section Sections 3-609, 3-609.1, 3-620, 3-621, 3-622,
113-623, 3-624, 3-625, 3-626, 3-628, 3-638, 3-642, 3-645, 3-647,
123-650, 3-651, 3-664, 3-666, 3-667, 3-668, 3-669, 3-676, 3-677,
133-680, 3-681, 3-683, 3-686, 3-688, 3-693, 3-698, or 3-699.12,
14or 3-699.16 may reclass his or her registration upon acquiring
15a special license plate listed in this subsection (b-5) without
16a replacement plate fee or registration sticker cost.
17    (b-10) Beginning with the 2019 registration year, any
18individual who has a special license plate issued under Section
193-609, 3-609.1, 3-620, 3-621, 3-622, 3-623, 3-624, 3-625,
203-626, 3-628, 3-638, 3-642, 3-645, 3-647, 3-650, 3-651, 3-664,
213-666, 3-667, 3-668, 3-669, 3-676, 3-677, 3-680, 3-681, 3-683,
223-686, 3-688, 3-693, 3-698, or 3-699.12, or 3-699.16 may
23reclass his or her special license plate upon acquiring a new
24registration under Section 3-405 or 3-405.1 without a
25replacement plate fee or registration sticker cost.
26    (c) When upgrading the weight of a registration within the

1same plate category, the owner shall pay the difference in
2current period fees between the two plates. In addition, the
3appropriate replacement plate and replacement sticker fees
4shall be assessed. In the event new plates are not required,
5the corrected registration card fee shall be assessed.
6    (d) In the event the owner of the vehicle desires to change
7the registered weight and change the plate category, the owner
8shall receive credit for the unused portion of the registration
9fee of the current plate and pay the current portion of the
10registration fee for the new plate, and in addition, pay the
11appropriate replacement plate and replacement sticker fees.
12    (e) Reclassing from one plate category to another plate
13category can be done only once within any registration period.
14    (f) No refunds shall be made in any of the circumstances
15found in subsection (b), subsection (c), or subsection (d);
16however, when reclassing from a flat weight plate to an
17apportioned plate, a refund may be issued if the credit amounts
18to an overpayment.
19    (g) In the event the registration of a vehicle registered
20under the mileage tax option is revoked, the owner shall be
21required to pay the annual registration fee in the new plate
22category and shall not receive any credit for the mileage plate
23fees.
24    (h) Certain special interest plates may be displayed on
25first division vehicles, second division vehicles weighing
268,000 pounds or less, and recreational vehicles. Those plates

1can be transferred within those vehicle groups.
2    (i) Plates displayed on second division vehicles weighing
38,000 pounds or less and passenger vehicle plates may be
4reclassed from one division to the other.
5    (j) Other than in subsection (i), reclassing from one
6division to the other division is prohibited. In addition, a
7reclass from a motor vehicle to a trailer or a trailer to a
8motor vehicle is prohibited.

12    Sec. 3-806.3. Senior citizens. Commencing with the 2009
13registration year, the registration fee paid by any vehicle
14owner who has been approved for benefits under the Senior
15Citizens and Persons with Disabilities Property Tax Relief Act
16or who is the spouse of such a person shall be $24 instead of
17the fee otherwise provided in this Code for passenger cars
18displaying standard multi-year registration plates issued
19under Section 3-414.1, motor vehicles displaying special
20registration plates issued under Section 3-609, 3-616, 3-621,
213-622, 3-623, 3-624, 3-625, 3-626, 3-628, 3-638, 3-642, 3-645,
223-647, 3-650, 3-651, or 3-663, or 3-699.16, motor vehicles
23registered at 8,000 pounds or less under Section 3-815(a), and
24recreational vehicles registered at 8,000 pounds or less under
25Section 3-815(b). Widows and widowers of claimants shall also

1be entitled to this reduced registration fee for the
2registration year in which the claimant was eligible.
3    Commencing with the 2009 registration year, the
4registration fee paid by any vehicle owner who has claimed and
5received a grant under the Senior Citizens and Persons with
6Disabilities Property Tax Relief Act or who is the spouse of
7such a person shall be $24 instead of the fee otherwise
8provided in this Code for passenger cars displaying standard
9multi-year registration plates issued under Section 3-414.1,
10motor vehicles displaying special registration plates issued
11under Section 3-607, 3-609, 3-616, 3-621, 3-622, 3-623, 3-624,
123-625, 3-626, 3-628, 3-638, 3-642, 3-645, 3-647, 3-650, 3-651,
133-663, or 3-664, or 3-699.16, motor vehicles registered at
148,000 pounds or less under Section 3-815(a), and recreational
15vehicles registered at 8,000 pounds or less under Section
163-815(b). Widows and widowers of claimants shall also be
17entitled to this reduced registration fee for the registration
18year in which the claimant was eligible.
19    Commencing with the 2017 registration year, the reduced fee
20under this Section shall apply to any special registration
21plate authorized in Article VI of Chapter 3 of this Code for
22which the applicant would otherwise be eligible.
23    Surcharges for vehicle registrations under Section 3-806
24of this Code shall not be collected from any vehicle owner who
25has been approved for benefits under the Senior Citizens and
26Disabled Persons Property Tax Relief Act or a person who is the

1spouse of such a person.
2    No more than one reduced registration fee under this
3Section shall be allowed during any 12-month period based on
4the primary eligibility of any individual, whether such reduced
5registration fee is allowed to the individual or to the spouse,
6widow or widower of such individual. This Section does not
7apply to the fee paid in addition to the registration fee for
8motor vehicles displaying vanity, personalized, or special
9license plates.

12    Section 99. Effective date. This Act takes effect July 1,
