1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by changing
5Sections 12-806 and 12-806a as follows:
 
6    (625 ILCS 5/12-806)  (from Ch. 95 1/2, par. 12-806)
7    Sec. 12-806. Identification, stop signal arms and special
8lighting when not used as a school bus.
9    (a) Except as provided in Section 12-806a, whenever a
10school bus is operated for the purpose of transporting
11passengers over 18 years of age other than persons in
12connection with an activity of the school or religious
13organization which owns the school bus or for which the school
14bus is operated, the "SCHOOL BUS" signs shall be covered or
15concealed and the stop signal arm and flashing signal system
16shall not be operable through normal controls.
17    (b) If a school district, religious organization, vendor of
18school buses busses, or school bus company whose main source of
19income is contracting with a school district or religious
20organization for the provision of transportation services in
21connection with the activities of a school district or
22religious organization, discards through either sale or
23donation, a school bus to an individual or entity that is not

1one of the aforementioned entities above, then the recipient of
2such school bus shall be responsible for immediately removing,
3covering, or concealing the "SCHOOL BUS" signs and any other
4insignia or words indicating the vehicle is a school bus,
5rendering inoperable or removing entirely the stop signal arm
6and flashing signal system, and painting the school bus a
7different color from those under Section 12-801 of this Code.

10    Sec. 12-806a. Identification, stop signal arms, and
11special lighting on school buses used to transport children
12outside of a school activity or persons in connection with a
13youth camp, child care facility, or community based
14rehabilitation facility.
15    (a) Subject to the conditions in Subsection (c), a bus
16which meets any of the special requirements for school buses in
17Section 12-801, 12-802, 12-803, and 12-805 of this Code may be
18used for the purpose of transporting persons 18 years of age or
19less. in connection with any of the following facilities:
20        (i) any youth camp licensed under the Youth Camp Act;
21    and
22        (ii) any child care facility licensed under the Child
23    Care Act of 1969.
24    (b) Subject to the conditions in subsection (c), a bus
25which meets any of the special requirements for school buses in

1Sections 12-801, 12-802, 12-803 and 12-805 of this Code may be
2used for the purpose of transporting persons recognized as
3clients of a community based rehabilitation facility which is
4accredited by the Commission on Accreditation of
5Rehabilitation Facilities of Tucson, Arizona, and which is
6under a contractual agreement with the Department of Human
7Services.
8    (c) A bus used for transportation as provided in subsection
9(a) or (b) shall either (i) meet all of the special
10requirements for school buses in Section 12-801, 12-802, 12-803
11and 12-805 or (ii) shall have the "SCHOOL BUS" signs covered or
12concealed and the stop signal arm and flashing signal system
13rendered inoperable through normal means. A bus which meets all
14of the special requirements for school buses in Section 12-801,
1512-802, 12-803 and 12-805 shall be operated by a person who has
16a valid and properly classified driver's license issued by the
17Secretary of State and who possesses a valid school bus driver
18permit or is accompanied and supervised, for the specific
19purpose of training prior to routine operation of a school bus,
20by a person who has held a valid school bus driver permit for
21at least one year. A bus which has had the "SCHOOL BUS" signs
22covered or concealed and the stop signal arm and flashing
23signal system rendered inoperable through normal means may be
24operated by a person who has a valid and properly classified
25driver's license issued by the Secretary of State.
