AMENDMENT TO SENATE BILL 2327

2    AMENDMENT NO. ______. Amend Senate Bill 2327 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Video Gaming Act is amended by adding
5Sections 43 and 79.5 and by changing Section 58 as follows:
 
6    (230 ILCS 40/43 new)
7    Sec. 43. Notice of alleged violation of Section 40. In all
8instances of an alleged violation of Section 40, the Board or
9its agents or designees shall provide written notice of the
10alleged violation to the affected licensed establishment,
11licensed fraternal establishment, licensed veterans
12establishment, or licensed truck stop establishment within 15
13days after the alleged occurrence of the violation.

15    Sec. 58. Location of terminals. Video gaming terminals in

1a licensed establishment, licensed fraternal establishment, or
2licensed veterans establishment must be located in an area that
3is restricted to persons over 21 years of age and the entrance
4to the area must be which is within the view of at least one
5employee of the establishment , who is over 21 years of age, of
6the establishment in which they are located.
7    Video gaming terminals in a licensed truck stop
8establishment must be:
9        (1) located in an area that is restricted to persons
10    over 21 years of age and the entrance to the area must be
11    within the view of at least one employee of the
12    establishment who is over 21 years of age; or
13        (2) monitored through a closed circuit television
14    monitor that is located on the premises and is within the
15    direct view of at least one employee of the establishment
16    who is over 21 years of age.
17    The placement of video gaming terminals in licensed
18establishments, licensed truck stop establishments, licensed
19fraternal establishments, and licensed veterans establishments
20shall be subject to the rules promulgated by the Board pursuant
21to the Illinois Administrative Procedure Act.

24    Sec. 79.5. Enforcement actions. The Board shall establish
25a policy and standards for compliance operations to investigate

1whether a licensed establishment, licensed fraternal
2establishment, licensed veterans establishment, or a licensed
3truck stop establishment is: (1) permitting any person under
4the age of 21 years to use or play a video gaming terminal in
5violation of this Act; or (2) furnishing alcoholic liquor to
6persons under 21 years of age in violation of the Liquor
7Control Act of 1934.
8    The policy and standards for compliance operations under
9this Section shall be similar to the model policy and
10guidelines for the operation of alcohol and tobacco compliance
11checks by local law enforcement officers adopted by the
12Illinois Law Enforcement Training Standards Board pursuant to
13subsection (c) of Section 6-16.1 of the Liquor Control Act of
141934. The Board shall adopt the policy and standards in the
15form of emergency rulemaking that shall be adopted no later
16than 90 days after the effective date of this amendatory Act of
17the 100th General Assembly and shall be immediately followed by
18permanent rulemaking on the same subject.
19    A licensed establishment, licensed fraternal
20establishment, licensed veterans establishment, or licensed
21truck stop establishment that is the subject of an enforcement
22action under this Section and is found, pursuant to the
23enforcement action, to be in compliance with this Act shall be
24notified by the Board that no violation was found within 30
25days after the finding.

1    Section 99. Effective date. This Act takes effect upon
2becoming law.".
