SYNOPSIS AS INTRODUCED:

230 ILCS 40/58

    Amends the Video Gaming Act. Provides that the Illinois Gaming Board must provide a licensed establishment, licensed truck stop establishment, licensed fraternal establishment, or licensed veterans establishment that violates the Act written notice of the violation within 15 days after the violation. Provides that video gaming terminals in a licensed truck stop establishment must be located in an area restricted to persons over 21 years of age and the entrance to the area must be within the view of at least one employee of the establishment who is over 21 years of age, or monitored through a closed circuit television monitor located on the premises and within the direct view of at least one employee of the establishment who is over 21 years of age (rather than located in an area restricted to persons over 21 years of age the entrance to which is within the view of at least one employee, who is over 21 years of age, of the licensed truck stop establishment). Makes conforming changes. Effective immediately.

1    AN ACT concerning gaming.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Video Gaming Act is amended by adding
5Section 43 and by changing Section 58 as follows:
 
6    (230 ILCS 40/43 new)
7    Sec. 43. Notice of violation. The Board must provide a
8licensed establishment, licensed truck stop establishment,
9licensed fraternal establishment, or licensed veterans
10establishment that violates this Act written notice of the
11violation within 15 days after the violation.

13    Sec. 58. Location of terminals. Video gaming terminals in
14a licensed establishment, licensed fraternal establishment, or
15licensed veterans establishment must be located in an area that
16is restricted to persons over 21 years of age and the entrance
17to the area must be which is within the view of at least one
18employee of the establishment , who is over 21 years of age, of
19the establishment in which they are located.
20    Video gaming terminals in a licensed truck stop
21establishment must be:
22        (1) located in an area that is restricted to persons

1    over 21 years of age and the entrance to the area must be
2    within the view of at least one employee of the
3    establishment who is over 21 years of age; or
4        (2) monitored through a closed circuit television
5    monitor that is located on the premises and is within the
6    direct view of at least one employee of the establishment
7    who is over 21 years of age.
8    The placement of video gaming terminals in licensed
9establishments, licensed truck stop establishments, licensed
10fraternal establishments, and licensed veterans establishments
11shall be subject to the rules promulgated by the Board pursuant
12to the Illinois Administrative Procedure Act.

14    Section 99. Effective date. This Act takes effect upon
15becoming law.
