AMENDMENT TO SENATE BILL 1997

2    AMENDMENT NO. ______. Amend Senate Bill 1997 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Juvenile Court Act of 1987 is amended by
5changing Section 2-5 as follows:
 
6    (705 ILCS 405/2-5)  (from Ch. 37, par. 802-5)
7    Sec. 2-5. Taking into custody. (1) A law enforcement
8officer may, without a warrant, take into temporary custody a
9minor (a) whom the officer with reasonable cause believes to be
10a person described in Section 2-3 or 2-4; (b) who has been
11adjudged a ward of the court and has escaped from any
12commitment ordered by the court under this Act; or (c) who is
13found in any street or public place suffering from any sickness
14or injury which requires care, medical treatment or
15hospitalization.
16    (2) Whenever a petition has been filed under Section 2-13

1and the court finds that the conduct and behavior of the minor
2may endanger the health, person, welfare, or property of
3himself or others or that the circumstances of his home
4environment may endanger his health, person, welfare or
5property, a warrant may be issued immediately to take the minor
6into custody.
7    (3) The taking of a minor into temporary custody under this
8Section is not an arrest nor does it constitute a police
9record.
10    (4) After taking temporary custody of a minor under this
11Section, the law enforcement officer or the Department of
12Children and Family Services, in consultation with the State's
13Attorney's Office, may transport the minor to a child advocacy
14center or other age-appropriate facility to conduct and
15electronically record a forensic interview with the minor. For
16purposes of this Section, the law enforcement officer or the
17Department of Children and Family Services may consent to the
18recording of the interview of the minor.
