AMENDMENT TO SENATE BILL 1894

2    AMENDMENT NO. ______. Amend Senate Bill 1894 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Video Gaming Act is amended by changing
5Section 60 as follows:
 
6    (230 ILCS 40/60)
7    Sec. 60. Imposition and distribution of tax.
8    (a) A tax of 30% is imposed on net terminal income and
9shall be collected by the Board.
10    (b) Of the tax collected under this Section from a licensed
11establishment, licensed truck stop establishment, or licensed
12fraternal establishment, five-sixths shall be deposited into
13the Capital Projects Fund and one-sixth shall be deposited into
14the Local Government Video Gaming Distributive Fund.
15    (b-1) Of the tax collected under this Section from a
16licensed veterans establishment, 83% shall be deposited into

1the Capital Projects Fund, 16% shall be deposited into the
2Local Government Video Gaming Distributive Fund, and 1% shall
3be disbursed equally to veterans service organizations
4throughout the State. Of the 1% paid to veterans service
5organizations, 75% must be used by the veterans service
6organizations' veteran services offices. Upon request of the
7Board, a veterans service organization must provide
8documentation that the spending of any moneys received under
9this subsection (b-1) complies with the requirements of this
10subsection (b-1). As used in this subsection (b-1), "veterans
11service organization" has the meaning given to that term in
12Section 10.8 of the Illinois Lottery Law.
13    (c) Revenues generated from the play of video gaming
14terminals shall be deposited by the terminal operator, who is
15responsible for tax payments, in a specially created, separate
16bank account maintained by the video gaming terminal operator
17to allow for electronic fund transfers of moneys for tax
18payment.
19    (d) Each licensed establishment, licensed truck stop
20establishment, licensed fraternal establishment, and licensed
21veterans establishment shall maintain an adequate video gaming
22fund, with the amount to be determined by the Board.
23    (e) The State's percentage of net terminal income shall be
24reported and remitted to the Board within 15 days after the
2515th day of each month and within 15 days after the end of each
26month by the video terminal operator. A video terminal operator

1who falsely reports or fails to report the amount due required
2by this Section is guilty of a Class 4 felony and is subject to
3termination of his or her license by the Board. Each video
4terminal operator shall keep a record of net terminal income in
5such form as the Board may require. All payments not remitted
6when due shall be paid together with a penalty assessment on
7the unpaid balance at a rate of 1.5% per month.
