1    AN ACT concerning property.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:

Article 5. Department of Natural Resources.

 
5    Section 5-5. The Director of the Department of Natural
6Resources, on behalf of the State of Illinois, is authorized to
7execute and deliver to the Fox Waterway Agency, a
8special-purpose unit of local government organized and
9existing under the laws of this State, for and in consideration
10of $1 paid to the Department, a quit claim deed to the
11following described real property:

13A tract conveyed to the State of Illinois, Department of
14Transportation, Division of Water Resources (now Department of
15Natural Resources) by Document No. 91R016102, dated May 9, 1991

16    Section 5-10. Conditions on transfer.
17    (a) The conveyances of real property authorized by Section
185-5 shall be made subject to: (1) existing public utilities,
19existing public roads, and any and all reservations, easements,
20encumbrances, covenants and restrictions of record; (2) the
21express condition that within one year after conveyance, the
22Fox Waterway Agency shall: sell the real property for no less
23than fair market value; use any proceeds from the sale to
24purchase of an alternate dredge material disposal site or sites

1for no more than fair market value; and transfer any proceeds
2remaining after the purchase of an alternate dredge material
3disposal site or sites to the Department of Natural Resources
4for deposit into the General Revenue Fund; and (3) the
5requirements of subsection (b) of this Section.
6    (b) If, after one year following the conveyances of the
7real property under Section 5-5, the Fox Waterway Agency has
8failed to comply with the express condition set forth in item
9(2) of subsection (a), the real property shall revert to the
10State of Illinois, Department of Natural Resources, or, if
11applicable, the proceeds from the sale of the conveyed property
12shall be immediately transferred to the Department of Natural
13Resources for deposit into the General Revenue Fund. If any
14property purchased with proceeds from the sale of the conveyed
15property is not used as a dredged material disposal site within
162 years following the conveyances under Section 5-5 or if at
17any time the property ceases to be used for public purposes,
18the Fox Waterway Agency shall convey by quitclaim deed the
19property to the Department of Natural Resources for $1. As used
20in this Section, "fair market value" means the average of 3
21appraisals plus the costs of obtaining the appraisals.
 
22    Section 5-15. The Director of the Department of Natural
23Resources, on behalf of the State of Illinois, is authorized to

9    Section 5-50. The Director of the Department of Natural
10Resources, on behalf of the State of Illinois, is authorized to
11exchange certain real property in Pulaski County, Illinois,
12hereinafter referred to in this Section as Parcel 1, for
13certain real property of equal or greater value in Pulaski
14County, Illinois, hereinafter referred to in this Section as
15Parcel 2, the Parcels being described as follows:
 
16    PARCEL 1:
17    The North 106 feet of the following described tract of land
18conveyed to the People of the State of Illinois, Department of
19Natural Resources, Springfield, IL., by Warranty Deed dated
20June 19, 2009, recorded June 25, 2009, Document No. 24582, in
21Book 257, Page 816, described as follows to-wit:
22    "A tract of land in the Southwest Quarter of the Northwest

20    Section 5-55. The transaction under Section 5-50 will be to
21the mutual advantages of both parties. Each party shall be
22responsible for any and all title costs associated with their

1    Section 5-60. The conveyance of Parcel 1 as authorized by
2Section 5-50 shall be made subject to existing public
3utilities, existing public roads, and any and all reservations,
4easements, encumbrances, covenants, and restrictions of
5record.
 
6    Section 5-65. The Director of the Department of Natural
7Resources shall obtain an opinion of title from the Attorney
8General certifying that the State of Illinois will receive
9merchantable title to the real property in Section 5-50
10referred to as Parcel 2.
 
11    Section 5-70. The Director of Natural Resources shall
12obtain a certified copy of the portions of this Act containing
13the title, the enacting clause, the effective date, the
14appropriate Section or Sections containing the land
15descriptions of the property to be conveyed, and this Section
16within 60 days after its effective date and, upon receipt of
17the payment required by the Section or Sections, if any payment
18is required, shall record the certified document in the
19Recorder's Office in the county in which the land is located.
