SYNOPSIS AS INTRODUCED:
 
110 ILCS 805/3-7.10  from Ch. 122, par. 103-7.10

    Amends the Public Community College Act. Provides that various petitions and filings must be filed with the county clerk or the county board of election commissioners, as the case may be, of the county in which the principal office of the community college board is located, rather than the secretary of the board of trustees. Makes conforming changes.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Public Community College Act is amended by
5changing Section 3-7.10 as follows:
 
6    (110 ILCS 805/3-7.10)  (from Ch. 122, par. 103-7.10)
7    Sec. 3-7.10. Nominations for members of the board shall be
8made by a petition signed by at least 50 voters or 10% of the
9voters, whichever is less, residing within the district and
10shall be filed with the county clerk or the county board of
11election commissioners, as the case may be, of the county in
12which the principal office of the community college board is
13located secretary of the board. In addition to the requirements
14of the general election law, the form of such petitions shall
15be substantially as follows:

6    Nomination papers filed under this Section are not valid
7unless the candidate named therein files with the county clerk
8or the county board of election commissioners, as the case may
9be, of the county in which the principal office of the
10community college board is located, together with secretary of
11the board a receipt from the county clerk, if filing with a
12county board of election commissioners, showing that the
13candidate has filed a statement of economic interests as
14required by the Illinois Governmental Ethics Act. Such receipt
15shall be so filed either previously during the calendar year in
16which his nomination papers were filed or within the period for
17the filing of nomination papers in accordance with the general
18election law.
19    The county clerk or the county board of election
20commissioners, as the case may be, of the county in which the
21principal office of the community college board is located
22secretary of the board shall notify each candidate, or the
23appropriate committee, for whom a petition for nomination has
24been filed of their obligations under the Campaign Financing
25Act, as required by the general election law. Such notice shall

1be given on a form prescribed by the State Board of Elections
2and in accordance with the requirements of the general election
3law.
4    All petitions for the nomination of members of a board of
5trustees shall be filed with the county clerk or the county
6board of election commissioners, as the case may be, of the
7county in which the principal office of the community college
8board is located secretary of the board within the time
9provided for by the general election law. Said county clerk or
10board of election commissioners secretary shall make
11certification to the proper election authority in accordance
12with the requirements of the general election law. If the
13secretary is an incumbent board member seeking reelection, a
14disinterested person must be a witness to the filing of his
15petition. It is the duty of the county clerk or board of
16election commissioners, as the case may be, secretary to
17provide candidates with petition forms and statements of
18candidacy.
19    The county clerk or board of election commissioners, as the
20case may be, secretary shall within 7 days of filing or on the
21last day for filing, whichever is earlier, acknowledge to the
22petitioner in writing his or its acceptance of the petition.
23    In all newly organized districts the petition for the
24nomination of candidates for members of the board at the first
25election shall be addressed to and filed with the regional
26superintendent in the manner specified for the petitions for

1candidates of a community college board. For such election the
2regional superintendent shall fulfill all duties otherwise
3assigned to the secretary of the board.
