SYNOPSIS AS INTRODUCED:
 
815 ILCS 505/2TTT new

    Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that no seller may discriminate, with respect to the price charged for services of similar or like kind, against a person because of the person's gender. Provides that nothing in the provisions of the amendatory Act: (1) prohibits price differences based specifically upon the amount of time, difficulty, or cost of providing the services; or (2) alters or affects the provisions of the Illinois Insurance Code or other laws that govern health care service plan or insurer underwriting or rating practices. Requires certain sellers to: (a) clearly and conspicuously disclose to consumers in writing the pricing for each standard service provided; (b) provide consumers with a complete written price list upon request; and (c) display in a conspicuous place at least one clearly visible sign, which reads: "ILLINOIS LAW PROHIBITS DISCRIMINATION WITH RESPECT TO THE PRICE CHARGED FOR SERVICES OF SIMILAR OR LIKE KIND, AGAINST A PERSON BECAUSE OF THE PERSON'S GENDER. A COMPLETE PRICE LIST IS AVAILABLE UPON REQUEST." Contains provisions concerning remedies and civil liabilities. Defines "standard service".

1    AN ACT concerning business.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Consumer Fraud and Deceptive Business
5Practices Act is amended by adding Section 2TTT as follows:
 
6    (815 ILCS 505/2TTT new)
7    Sec. 2TTT. Standard services; charges.
8    (a) No seller may discriminate, with respect to the price
9charged for services of similar or like kind, against a person
10because of the person's gender.
11    (b) Nothing in subsection (a) prohibits price differences
12based specifically upon the amount of time, difficulty, or cost
13of providing the services.
14    (c) Except as provided in subsection (e), the remedies for
15a violation of this Section are the remedies provided in
16Sections 7 and 10a of this Act. However, an action under this
17Section is independent of any other remedy or procedure that
18may be available to a consumer.
19    (d) This Section does not alter or affect the provisions of
20the Illinois Insurance Code or other laws that govern health
21care service plan or insurer underwriting or rating practices.
22    (e)(1) The following sellers shall clearly and
23conspicuously disclose to the consumer in writing the pricing

1for each standard service provided:
2        (A) Tailors or businesses providing aftermarket
3    clothing alterations.
4        (B) Barbers or hair salons.
5        (C) Dry cleaners and laundries providing services to
6    individuals.
7    (2) The price list shall be posted in an area conspicuous
8to consumers. Posted price lists shall be in no less than
914-point boldface type and clearly and completely display
10pricing for every standard service offered by the seller under
11paragraph (1).
12    (3) The seller shall provide the consumer with a complete
13written price list upon request.
14    (4) The seller shall display in a conspicuous place at
15least one clearly visible sign, printed in no less than
1624-point boldface type, which reads: "ILLINOIS LAW PROHIBITS
17DISCRIMINATION WITH RESPECT TO THE PRICE CHARGED FOR SERVICES
18OF SIMILAR OR LIKE KIND, AGAINST A PERSON BECAUSE OF THE
19PERSON'S GENDER. A COMPLETE PRICE LIST IS AVAILABLE UPON
20REQUEST."
21    (5) A seller who fails to correct a violation of this
22subsection within 30 days of receiving written notice of the
23violation is liable for a civil penalty of $1,000.
24    (6) As used in this subsection, "standard service" means
25the 15 most frequently requested services provided by the
26seller.
