1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by changing Section
524A-7 as follows:
 
6    (105 ILCS 5/24A-7)  (from Ch. 122, par. 24A-7)
7    Sec. 24A-7. Rules. The State Board of Education is
8authorized to adopt such rules as are deemed necessary to
9implement and accomplish the purposes and provisions of this
10Article, including, but not limited to, rules (i) relating to
11the methods for measuring student growth (including, but not
12limited to, limitations on the age of useable data; the amount
13of data needed to reliably and validly measure growth for the
14purpose of teacher and principal evaluations; and whether and
15at what time annual State assessments may be used as one of
16multiple measures of student growth), (ii) defining the term
17"significant factor" for purposes of including consideration
18of student growth in performance ratings, (iii) controlling for
19such factors as student characteristics (including, but not
20limited to, students receiving special education and English
21Language Learner services), student attendance, and student
22mobility so as to best measure the impact that a teacher,
23principal, school and school district has on students' academic

1achievement, (iv) establishing minimum requirements for
2district teacher and principal evaluation instruments and
3procedures, and (v) establishing a model evaluation plan for
4use by school districts in which student growth shall comprise
550% of the performance rating. Notwithstanding any provision in
6this Section, such rules shall not preclude a school district
7having 500,000 or more inhabitants from using an annual State
8assessment as the sole measure of student growth for purposes
9of teacher or principal evaluations.
10    The State Superintendent of Education shall convene The
11rules shall be developed through a process involving
12collaboration with a Performance Evaluation Advisory Council,
13which shall be convened and staffed by the State Board of
14Education. Members of the Council shall be selected by the
15State Superintendent and include, without limitation,
16representatives of teacher unions and school district
17management, persons with expertise in performance evaluation
18processes and systems, as well as other stakeholders. The
19Performance Evaluation Advisory Council shall meet at least
20quarterly, and may also meet at the call of the chairperson of
21the Council, following the effective date of this amendatory
22Act of the 100th 96th General Assembly until June 30, 2021
232017. The Council shall advise the State Board of Education on
24the ongoing implementation of performance evaluations in this
25State, which may include gathering public feedback, sharing
26best practices, consulting with the State Board on any proposed

1rule changes regarding evaluations, and other subjects as
2determined by the chairperson of the Council.
3    Prior to the applicable implementation date, these rules
4shall not apply to teachers assigned to schools identified in
5an agreement entered into between the board of a school
6district operating under Article 34 of this Code and the
7exclusive representative of the district's teachers in
8accordance with Section 34-85c of this Code.

11    Section 99. Effective date. This Act takes effect upon
12becoming law.
