AMENDMENT TO SENATE BILL 440

2    AMENDMENT NO. ______. Amend Senate Bill 440 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Board of Higher Education Act is amended by
5changing Sections 2, 3, and 4 as follows:
 
6    (110 ILCS 205/2)  (from Ch. 144, par. 182)
7    Sec. 2. There is created a Board of Higher Education to
8consist of 18 16 members as follows: 10 members appointed by
9the Governor, by and with the advice and consent of the Senate;
10one member of a public university governing board, appointed by
11the Governor without the advice and consent of the Senate; one
12member of a private college or university board of trustees,
13appointed by the Governor without the advice and consent of the
14Senate; the chairman of the Illinois Community College Board;
15the chairman of the Illinois Student Assistance Commission; and
162 student members selected by the recognized advisory committee

1of students of the Board of Higher Education, one of whom must
2be a non-traditional undergraduate student who is at least 24
3years old and represents the views of non-traditional students,
4such as a person who is employed or is a parent; and 2
5full-time faculty members selected by the recognized advisory
6council of faculty of the Board of Higher Education. Beginning
7on July 1, 2005, one of the 10 members appointed by the
8Governor, by and with the advice and consent of the Senate,
9must be a faculty member at an Illinois public university. The
10Governor shall designate the Chairman of the Board to serve
11until a successor is designated. The chairmen of the Board of
12Trustees of the University of Illinois, the Board of Trustees
13of Southern Illinois University, the Board of Governors of
14State Colleges and Universities, and the Board of Regents of
15Regency Universities shall cease to be members of the Board of
16Higher Education on the effective date of this amendatory Act
17of 1995. No more than 7 of the members appointed by the
18Governor, excluding the Chairman, shall be affiliated with the
19same political party. The 10 members appointed by the Governor
20with the advice and consent of the Senate shall be citizens of
21the State and shall be selected, as far as may be practicable,
22on the basis of their knowledge of, or interest or experience
23in, problems of higher education. If the Senate is not in
24session or is in recess, when appointments subject to its
25confirmation are made, the Governor shall make temporary
26appointments which shall be subject to subsequent Senate

4    Sec. 3. Terms; vacancies.
5    (a) The members of the Board whose appointments are subject
6to confirmation by the Senate shall be selected for 6-year
7terms expiring on January 31 of odd numbered years. Of the
8initial appointees, however, 2 shall be designated by the
9Governor to serve until January 31, 1963, 3 until January 31,
101965, and 3 until January 31, 1967.
11    Of the 2 appointees to be made by the Governor pursuant to
12this Act as amended by the 75th General Assembly, one shall be
13designated to serve until January 31, 1971 and one until
14January 31, 1973.
15    (b) The members of the Board shall continue to serve after
16the expiration of their terms until their successors have been
17appointed.
18    (c) Vacancies on the Board in offices appointed by the
19Governor shall be filled by appointment by the Governor for the
20unexpired term. If the appointment is subject to Senate
21confirmation and the Senate is not in session or is in recess
22when the appointment is made, the appointee shall serve subject
23to subsequent Senate approval of the appointment.
24    (d) Each student member shall serve a term of one year
25beginning on July 1 of each year, except that the student

1member initially selected under this amendatory Act of the 94th
2General Assembly shall serve a term beginning on the date of
3such selection and expiring on the next succeeding June 30.
4    (e) The member of the Board representing public university
5governing boards and the member of the Board representing
6private college and university boards of trustees, who are
7appointed by the Governor but not subject to confirmation by
8the Senate, shall serve terms of one year beginning on July 1.
9    The 2 members selected by the Board's recognized advisory
10council of faculty shall serve terms of one year beginning on
11July 1 and shall continue to serve after the expiration of
12their terms until their successors have been selected.

15    Sec. 4. The Board shall hold regular meetings at times
16specified in its rules. Special or additional meetings may be
17held on call of the Chairman, or upon a call signed by at least
188 6 members, or upon call of the Governor. Ten Eight members of
19the Board shall constitute a quorum at all its meetings, but
20the approval of a new unit of instruction, research, or public
21service for a public institution of higher education, as
22provided in Section 7 shall require the concurrence of a
23majority of all the members of the Board.
24    The Chairmen of the Illinois Community College Board and
25the Illinois Student Assistance Commission holding membership

1on the Board each may designate an alternate to attend any
2meeting of the Board, and an alternate so designated shall have
3all rights and privileges of regular membership while acting
4for the Chairman who has so designated him or her.
5    The Board may employ and fix the compensation of
6professional and clerical staff and other assistants,
7including specialists and consultants, as it may deem
8necessary, on a full or part time basis.
