    Creates the Toll Exemption for Motorcycles Act. Provides that a State agency or unit of local government may not collect a toll from a person operating a motorcycle upon any highway, roadway, bridge, or street. Denies home rule powers. Amends the Illinois Highway Code, the Toll Highway Act, the Toll Bridge Act, the Public Private Agreements for the Illiana Expressway Act, and the Public-Private Partnerships for Transportation Act to make conforming changes. Effective immediately.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the Toll
5Exemption for Motorcycles Act.
 
6    Section 5. Toll exemption for motorcycles.
7    (a) A State agency or unit of local government may not
8collect a toll from a person operating a motorcycle, as defined
9in Section 1-147 of the Illinois Vehicle Code, upon any
10highway, roadway, bridge, or street in this State.
11    (b) A home rule unit may not regulate the payment of a toll
12on a highway, roadway, bridge, or street by a person operating
13a motorcycle. This subsection is a denial and limitation of
14home rule powers and functions under subsection (g) of Section
156 of Article VII of the Illinois Constitution.
 
16    Section 10. The Illinois Highway Code is amended by adding
17Section 9-101.7 as follows:
 
18    (605 ILCS 5/9-101.7 new)
19    Sec. 9-101.7. Toll exemption for motorcycles.
20Notwithstanding any other provision of law, a person operating
21a motorcycle is exempt from paying any toll upon any highway,

1roadway, bridge, or street of this State, as provided in the
2Toll Exemption for Motorcycles Act.
 
3    Section 15. The Toll Highway Act is amended by adding
4Section 19.5 as follows:
 
5    (605 ILCS 10/19.5 new)
6    Sec. 19.5. Toll exemption for motorcycles. Notwithstanding
7any other provision of law, a person operating a motorcycle is
8exempt from paying any toll upon any highway, roadway, bridge,
9or street of this State, as provided in the Toll Exemption for
10Motorcycles Act.
 
11    Section 20. The Toll Bridge Act is amended by adding
12Section 7.1 as follows:
 
13    (605 ILCS 115/7.1 new)
14    Sec. 7.1. Toll exemption for motorcycles. Notwithstanding
15any other provision of law, a person operating a motorcycle is
16exempt from paying any toll upon any toll bridge in this State,
17as provided in the Toll Exemption for Motorcycles Act.
 
18    Section 25. The Public Private Agreements for the Illiana
19Expressway Act is amended by adding Section 73 as follows:

1    Sec. 73. Toll exemption for motorcycles. Notwithstanding
2any other provision of law, a person operating a motorcycle is
3exempt from paying any toll upon any highway, roadway, bridge,
4or street of this State, as provided in the Toll Exemption for
5Motorcycles Act.
 
6    Section 30. The Public-Private Partnerships for
7Transportation Act is amended by adding Section 43 as follows:
 
8    (630 ILCS 5/43 new)
9    Sec. 43. Toll exemption for motorcycles. Notwithstanding
10any other provision of law, a person operating a motorcycle is
11exempt from paying any toll upon any highway, roadway, bridge,
12or street of this State, as provided in the Toll Exemption for
13Motorcycles Act.
 
14    Section 99. Effective date. This Act takes effect upon
15becoming law.
