SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/12-4.51 new

    Amends the Medical Assistance Article of the Illinois Public Aid Code. Creates the Interagency Task Force on Medicaid Fraud to: (i) determine best practices for addressing Medicaid fraud under the State's Medical Assistance Program; (ii) improve communication between the Department of Human Services, the Department of Healthcare and Family Services, and the Illinois State Police concerning matters involving Medicaid fraud; and (iii) recommend legislation aimed at making investigations of Medicaid fraud by the Department of Human Services and the Department of Healthcare and Family Services more efficient and effective. Contains provisions concerning Task Force meetings; appointed members; reporting requirements; and other matters. Effective immediately.

1    AN ACT concerning public aid.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Public Aid Code is amended by
5adding Section 12-4.51 as follows:
 
6    (305 ILCS 5/12-4.51 new)
7    Sec. 12-4.51. Interagency Task Force on Medicaid Fraud.
8    (a) The Interagency Task Force on Medicaid Fraud is created
9to:
10        (1) determine best practices for addressing Medicaid
11    fraud under the State's Medical Assistance Program;
12        (2) improve communication between the Department of
13    Human Services, the Department of Healthcare and Family
14    Services, and the Illinois State Police Medicaid Fraud
15    Control Unit concerning matters involving Medicaid fraud;
16    and
17        (3) recommend legislation aimed at making
18    investigations of Medicaid fraud by the Department of Human
19    Services and the Department of Healthcare and Family
20    Services more efficient and effective.
21    (b) The Task Force shall meet 4 times a year. Each year,
22following its final meeting of the year, the Task Force shall
23submit a written report to the General Assembly with its

1findings and recommendations on appropriate measures the
2Department of Human Services and the Department of Healthcare
3and Family Services should take to reduce the occurrence of
4Medicaid fraud under the State's Medical Assistance Program.
5Members of the Task Force shall be appointed within 60 days
6after the effective date of this amendatory Act of the 100th
7General Assembly as provided in subsection (c). The Task Force
8shall hold its first meeting within 60 days after all members
9of the Task Force have been appointed as provided in subsection
10(c).
11    (c) The Task Force shall consist of 10 members appointed as
12follows:
13        (1) Four members from the General Assembly:
14            (A) one of whom shall be appointed by the Speaker
15        of the House of Representatives;
16            (B) one of whom shall be appointed by the President
17        of the Senate;
18            (C) one of whom shall be appointed by the House
19        Minority Leader; and
20            (D) one of whom shall be appointed by the Senate
21        Minority Leader.
22        (2) One member from and appointed by the Illinois State
23    Police Medicaid Fraud Control Unit.
24        (3) One member from and appointed by the Department of
25    Human Services' Office of the Inspector General who shall
26    have knowledge in matters concerning Medicaid fraud and the

1    State's Medical Assistance Program.
2        (4) One member from and appointed by the Department of
3    Healthcare and Family Services who shall have knowledge in
4    matters concerning Medicaid fraud and the State's Medical
5    Assistance Program.
6        (5) One member from and appointed by the Office of the
7    Attorney General.
8        (6) Two members appointed by the Governor who represent
9    provider advocacy groups that specialize in matters
10    concerning the State's Medical Assistance Program.
11    (d) Members of the Task Force shall serve without
12compensation.
13    (e) The Department of Human Services shall provide
14administrative support to the Task Force.
 
15    Section 99. Effective date. This Act takes effect upon
16becoming law.
