SYNOPSIS AS INTRODUCED:
 
65 ILCS 5/11-30-8.5 new

    Amends the Illinois Municipal Code. Provides that a municipality shall provide free snow removal at the residence of a person with a disability, senior, or veteran when one inch or more of snow accumulates on the ground. Provides that a person with a disability, senior, or veteran may receive free snow removal under these provisions only after he or she registers with the municipality providing the following information to the municipality: identification; proof of current residence; and, if applicable, signing a statement affirming that he or she is a person with a disability or a veteran. Defines terms. Limits home rule powers. Repeals the provisions 3 years after the effective date of the Act.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Municipal Code is amended by adding
5Section 11-30-8.5 as follows:
 
6    (65 ILCS 5/11-30-8.5 new)
7    Sec. 11-30-8.5. Free snow removal pilot program.
8    (a) As used in this Section:
9    "Free snow removal" means shoveling and salting a
10residence's driveway.
11    "Person with a disability" means a person who suffers from
12a permanent physical or mental impairment resulting from
13disease, injury, functional disorder or congenital condition.
14    "Residence" means a single-family residence occupied by a
15person with a disability, senior, or veteran.
16    "Senior" means a person 65 years of age or older.
17    "Veteran" means an Illinois resident who has served as a
18member of the United States Armed Services on active duty, a
19member of the Illinois National Guard, or a member of the
20United States Reserve Forces, and who has received an honorable
21discharge.
22    (b) A municipality shall provide free snow removal at the
23residence of a person with a disability, senior, or veteran

1that has registered under subsection (c) when one inch or more
2of snow accumulates on the ground.
3    (c) A person with a disability, senior, or veteran may
4receive free snow removal under this Section only after he or
5she registers with the municipality providing the following
6information to the municipality:
7        (1) identification;
8        (2) proof of current residence; and
9        (3) signing a statement affirming that he or she is a
10    person with a disability or a veteran, if applicable.
11    (d) A home rule municipality shall provide free snow
12removal to persons with a disability, seniors, and veterans in
13a manner no less restrictive than required in this Section.
14This Section is a limitation under subsection (i) of Section 6
15of Article VII of the Illinois Constitution on the concurrent
16exercise by home rule units of powers and functions exercised
17by the State.
18    (e) This Section is repealed 3 years after the effective
19date of this amendatory Act of the 100th General Assembly.
