SYNOPSIS AS INTRODUCED:

30 ILCS 805/8.42 new

    Amends the Chicago Firefighter Article of the Illinois Pension Code. Provides for noncompounded 3% automatic annual increases in all widow's annuities (other than term annuities) upon the widow's attainment of age 60 or the tenth anniversary of the fireman's death, whichever occurs later. Provides that the increases apply without regard to whether the deceased fireman is in service on or after the effective date of the amendatory Act. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

1    AN ACT concerning public employee benefits.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Pension Code is amended by adding
5Section 6-164.3 as follows:
 
6    (40 ILCS 5/6-164.3 new)
7    Sec. 6-164.3. Automatic annual increase in widow's
8annuity.
9    (a) Every widow's annuity, other than a term annuity, shall
10be increased on January 1, 2019 or the January 1 occurring on
11or immediately after the tenth anniversary of the deceased
12fireman's death or the widow's attainment of age 60, whichever
13occurs later, and on each subsequent January 1, by an amount
14equal to 3% of the original amount of the widow's annuity.
15    (b) Limitations on the maximum amount of widow's annuity
16imposed under this Article do not apply to the annual increases
17provided under this Section.
18    (c) The increases provided under this Section do apply to
19minimum widow's annuities. The increases provided under this
20Section do not apply to term annuities. The increases provided
21under this Section do apply without regard to whether the
22deceased fireman is in service on or after the effective date
23of this amendatory Act of the 100th General Assembly.

1    Section 90. The State Mandates Act is amended by adding
2Section 8.42 as follows:
 
3    (30 ILCS 805/8.42 new)
4    Sec. 8.42. Exempt mandate. Notwithstanding Sections 6 and 8
5of this Act, no reimbursement by the State is required for the
6implementation of any mandate created by this amendatory Act of
7the 100th General Assembly.
 
8    Section 99. Effective date. This Act takes effect upon
9becoming law.
