SYNOPSIS AS INTRODUCED:
 
105 ILCS 5/10-22.22  from Ch. 122, par. 10-22.22

    Amends the School Code. Provides that, beginning with the 2018-2019 school year, a school board with a pupil attending an area secondary vocational school shall pay the vocational school tuition based upon the vocational school's per capita cost or the school district's per capita cost, whichever one is greater (instead of just the vocational school's per capita cost). Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by changing Section
510-22.22 as follows:
 
6    (105 ILCS 5/10-22.22)  (from Ch. 122, par. 10-22.22)
7    Sec. 10-22.22. Transportation for pupils; tuition;
8vocational school pupils-Tuition.
9    To provide free transportation for pupils, and where in its
10judgment the interests of the district and of the pupils
11therein will be best subserved by so doing the school board may
12permit the pupils in the district or in any particular grade to
13attend the schools of other districts and may permit any pupil
14to attend an area secondary vocational school operated by a
15public school district or a public or non-public vocational
16school within the State of Illinois or adjacent states approved
17by the Board of Vocational Education, and may provide free
18transportation for such pupils and shall pay the tuition of
19such pupils in the schools attended; except as otherwise
20provided in this Section, such tuition shall be based upon per
21capita cost computed in the following manner: The cost of
22conducting and maintaining any area secondary vocational
23school facility shall be first determined and shall include the

1following expenses applicable only to such educational
2facility under rules and regulations established by the Board
3of Vocational Education and Rehabilitation as follows:
4        a. Salaries of teachers, vocational counselors, and
5    supporting professional workers, necessary non-certified
6    workers, clerks, custodial employees, and any district
7    taxes specifically for their pension and retirement
8    benefits.
9        b. Equipment and supplies necessary for program
10    operation.
11        c. Administrative costs.
12        d. Operation of physical plant, including heat, light,
13    water, repairs, and maintenance.
14        e. Auxiliary service, not including any transportation
15    cost.
16    From such total cost thus determined there shall be
17deducted the State reimbursement due on account of such
18educational facility for the same year, not including any State
19reimbursement for area secondary vocational school
20transportation. Such net cost shall be divided by the average
21number of pupils in average daily attendance in such area
22secondary vocational school facility for the school year in
23order to arrive at the net per capita tuition cost. Such costs
24shall be computed on pupils regularly enrolled in an area
25secondary vocational school on the basis of one-sixth day for
26every class hour attended pursuant to such enrollment.

1Provided, that the board subject to the approval of the county
2superintendent of schools may determine what schools outside of
3their district such pupils shall attend. This Section section
4does not require the board of directors or board of education
5of any district to admit pupils from another district.
6    Beginning with the 2018-2019 school year, the tuition to be
7paid by a school board under this Section shall be based upon
8the vocational school's per capita cost, as computed under this
9Section, or the school district's per capita cost, as computed
10under Section 10-20.12a of this Code, whichever one is greater.

12    Section 99. Effective date. This Act takes effect upon
13becoming law.
