SYNOPSIS AS INTRODUCED:
 
755 ILCS 5/11a-5.1 new

    Amends the Guardians for Adults With Disabilities Article of the Probate Act of 1975. Provides that the court may not appoint an individual the guardian of the person or estate of an adult with disabilities before the individual has disclosed to the court the number of adults with disabilities over which the individual is currently appointed as guardian. Provides that if the court determines that an individual is appointed guardian over more than 5 adults with disabilities, then the court shall issue an order directing the circuit court clerk to notify the Guardianship and Advocacy Commission, in a form and manner prescribed by the Commission. Provides that the clerk shall notify the Commission no later than 7 days after the entry of the order. Exempts the Office of the State Guardian and public guardians from the new provisions.

1    AN ACT concerning civil law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Probate Act of 1975 is amended by adding
5Section 11a-5.1 as follows:
 
6    (755 ILCS 5/11a-5.1 new)
7    Sec. 11a-5.1. Multiple guardianships. The court may not
8appoint an individual the guardian of the person or estate of
9an adult with disabilities before the individual has disclosed
10to the court the number of adults with disabilities over which
11the individual is currently appointed as guardian. If the court
12determines that an individual is appointed guardian over more
13than 5 adults with disabilities, then the court shall issue an
14order directing the circuit court clerk to notify the
15Guardianship and Advocacy Commission, in a form and manner
16prescribed by the Guardianship and Advocacy Commission. The
17clerk shall notify the Guardianship and Advocacy Commission no
18later than 7 days after the entry of the order. This Section
19does not apply to the Office of the State Guardian or a public
20guardian.
