1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by changing Sections
510-22.39 and 34-18.7 as follows:
 
6    (105 ILCS 5/10-22.39)
7    Sec. 10-22.39. In-service training programs.
8    (a) To conduct in-service training programs for teachers.
9    (b) In addition to other topics at in-service training
10programs, at least once every 2 years, licensed school
11personnel and administrators school guidance counselors,
12teachers, school social workers, and other school personnel who
13work with pupils in kindergarten grades 7 through grade 12
14shall be trained to identify the warning signs of mental
15illness and suicidal behavior in youth adolescents and teens
16and shall be taught appropriate intervention and referral
17techniques.
18    (c) School guidance counselors, nurses, teachers and other
19school personnel who work with pupils may be trained to have a
20basic knowledge of matters relating to acquired
21immunodeficiency syndrome (AIDS), including the nature of the
22disease, its causes and effects, the means of detecting it and
23preventing its transmission, and the availability of

1appropriate sources of counseling and referral, and any other
2information that may be appropriate considering the age and
3grade level of such pupils. The School Board shall supervise
4such training. The State Board of Education and the Department
5of Public Health shall jointly develop standards for such
6training.
7    (d) In this subsection (d):
8    "Domestic violence" means abuse by a family or household
9member, as "abuse" and "family or household members" are
10defined in Section 103 of the Illinois Domestic Violence Act of
111986.
12    "Sexual violence" means sexual assault, abuse, or stalking
13of an adult or minor child proscribed in the Criminal Code of
141961 or the Criminal Code of 2012 in Sections 11-1.20, 11-1.30,
1511-1.40, 11-1.50, 11-1.60, 12-7.3, 12-7.4, 12-7.5, 12-12,
1612-13, 12-14, 12-14.1, 12-15, and 12-16, including sexual
17violence committed by perpetrators who are strangers to the
18victim and sexual violence committed by perpetrators who are
19known or related by blood or marriage to the victim.
20    At least once every 2 years, an in-service training program
21for school personnel who work with pupils, including, but not
22limited to, school and school district administrators,
23teachers, school guidance counselors, school social workers,
24school counselors, school psychologists, and school nurses,
25must be conducted by persons with expertise in domestic and
26sexual violence and the needs of expectant and parenting youth

1and shall include training concerning (i) communicating with
2and listening to youth victims of domestic or sexual violence
3and expectant and parenting youth, (ii) connecting youth
4victims of domestic or sexual violence and expectant and
5parenting youth to appropriate in-school services and other
6agencies, programs, and services as needed, and (iii)
7implementing the school district's policies, procedures, and
8protocols with regard to such youth, including
9confidentiality. At a minimum, school personnel must be trained
10to understand, provide information and referrals, and address
11issues pertaining to youth who are parents, expectant parents,
12or victims of domestic or sexual violence.
13    (e) At least every 2 years, an in-service training program
14for school personnel who work with pupils must be conducted by
15persons with expertise in anaphylactic reactions and
16management.
17    (f) At least once every 2 years, a school board shall
18conduct in-service training on educator ethics,
19teacher-student conduct, and school employee-student conduct
20for all personnel.

1guidance counselors, teachers, school social workers, and
2other school personnel who work with pupils in kindergarten
3grades 7 through grade 12 shall be trained to identify the
4warning signs of mental illness and suicidal behavior in youth
5adolescents and teens and shall be taught various intervention
6techniques. Such training shall be provided within the
7framework of existing in-service training programs offered by
8the Board or as part of the professional development activities
9required under Section 21-14 of this Code.
