    Amends the Election Code. Provides that the Electronic Registration Information Center shall provide the exclusive interstate voter registration program for the State. Provides that the State Board of Elections shall not share identification records contained in databases maintained by State agencies with any interstate voter registration program other than the Electronic Registration Information Center. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

1    AN ACT concerning elections.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Election Code is amended by changing Section
51A-45 as follows:
 
6    (10 ILCS 5/1A-45)
7    Sec. 1A-45. Electronic Registration Information Center.
8    (a) The State Board of Elections shall enter into an
9agreement with the Electronic Registration Information Center
10effective no later than January 1, 2016, for the purpose of
11maintaining a statewide voter registration database. The
12Electronic Registration Information Center shall provide the
13exclusive interstate voter registration program for the State
14of Illinois. The State Board of Elections shall comply with the
15requirements of the Electronic Registration Information Center
16Membership Agreement. The State Board of Elections shall
17require a term in the Electronic Registration Information
18Center Membership Agreement that requires the State to share
19identification records contained in the Secretary of State's
20Driver Services Department and Vehicle Services Department,
21the Department of Human Services, the Department of Healthcare
22and Family Services, the Department of Aging, and the
23Department of Employment Security databases (excluding those

1fields unrelated to voter eligibility, such as income or health
2information).
3    (b) The Secretary of State and the Board of Elections shall
4enter into an agreement to permit the Secretary of State to
5provide the State Board of Elections with any information
6required for compliance with the Electronic Registration
7Information Center Membership Agreement. The Secretary of
8State shall deliver this information as frequently as necessary
9for the State Board of Elections to comply with the Electronic
10Registration Information Center Membership Agreement.
11    (b-5) The State Board of Elections and the Department of
12Human Services, the Department of Healthcare and Family
13Services, the Department on Aging, and the Department of
14Employment Security shall enter into an agreement to require
15each department to provide the State Board of Elections with
16any information necessary to transmit member data under the
17Electronic Registration Information Center Membership
18Agreement. The director or secretary, as applicable, of each
19agency shall deliver this information on an annual basis to the
20State Board of Elections pursuant to the agreement between the
21entities.
22    (b-10) The State Board of Elections shall not share
23identification records contained in databases maintained by
24the Secretary of State's Driver Services Department and Vehicle
25Services Department, the Department of Human Services, the
26Department of Healthcare and Family Services, the Department of

1Aging, the Department of Employment Security, or any other
2State database containing identification records with any
3interstate voter registration program other than the
4Electronic Registration Information Center.
5    (c) Any communication required to be delivered to a
6registrant or potential registrant pursuant to the Electronic
7Registration Information Center Membership Agreement shall
8include at least the following message:
9        "Our records show people at this address may not be
10    registered to vote at this address, but you may be eligible
11    to register to vote or re-register to vote at this address.
12    If you are a U.S. Citizen, a resident of Illinois, and will
13    be 18 years old or older before the next general election
14    in November, you are qualified to vote.
15        We invite you to check your registration online at
16    (enter URL) or register to vote online at (enter URL), by
17    requesting a mail-in voter registration form by (enter
18    instructions for requesting a mail-in voter registration
19    form), or visiting the (name of election authority) office
20    at (address of election authority)."
21    The words "register to vote online at (enter URL)" shall be
22bolded and of a distinct nature from the other words in the
23message required by this subsection (c).
24    (d) Any communication required to be delivered to a
25potential registrant that has been identified by the Electronic
26Registration Information Center as eligible to vote but who is

1not registered to vote in Illinois shall be prepared and
2disseminated at the direction of the State Board of Elections.
3All other communications with potential registrants or
4re-registrants pursuant to the Electronic Registration
5Information Center Membership Agreement shall be prepared and
6disseminated at the direction of the appropriate election
7authority.
8    (e) The Executive Director of the State Board of Elections
9or his or her designee shall serve as the Member Representative
10to the Electronic Registration Information Center.
11    (f) The State Board of Elections may adopt any rules
12necessary to enforce this Section or comply with the Electronic
13Registration Information Center Membership Agreement.

15    Section 90. The State Mandates Act is amended by adding
16Section 8.42 as follows:
 
17    (30 ILCS 805/8.42 new)
18    Sec. 8.42. Exempt mandate. Notwithstanding Sections 6 and 8
19of this Act, no reimbursement by the State is required for the
20implementation of any mandate created by this amendatory Act of
21the 100th General Assembly.
 
22    Section 99. Effective date. This Act takes effect upon
23becoming law.
