SYNOPSIS AS INTRODUCED:
 
625 ILCS 57/15

    Amends the Transportation Network Providers Act. Provides that an individual applying to become a transportation network company driver shall include in the application his or her full name and any used nicknames or aliases. Provides that an individual who submits an application that contains false or incomplete information shall be guilty of a petty offense. Provides that a transportation network company shall not permit an individual to act as a transportation network company driver on its digital platform if the individual has been placed on court supervision, within the past 7 years, for driving under the influence of drugs or alcohol. Effective July 1, 2018.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Transportation Network Providers Act is
5amended by changing Section 15 as follows:
 
6    (625 ILCS 57/15)
7    (Section scheduled to be repealed on June 1, 2020)
8    Sec. 15. Driver requirements.
9    (a) Prior to permitting an individual to act as a TNC
10driver on its digital platform, the TNC shall:
11        (1) require the individual to submit an application to
12    the TNC, which includes information regarding his or her
13    full name and any used nicknames or aliases, address, age,
14    driver's license, driving history, motor vehicle
15    registration, automobile liability insurance, and other
16    information required by the TNC;
17        (2) conduct, or have a third party conduct, a local and
18    national criminal history background check for each
19    individual applicant that shall include:
20            (A) Multi-State or Multi-Jurisdictional Criminal
21        Records Locator or other similar commercial nationwide
22        database with validation (primary source search); and
23            (B) National Sex Offenders Registry database; and

1        (3) obtain and review a driving history research report
2    for the individual.
3    (b) The TNC shall not permit an individual to act as a TNC
4driver on its digital platform who:
5        (1) has had more than 3 moving violations in the prior
6    three-year period, or one major violation in the prior
7    three-year period including, but not limited to,
8    attempting to evade the police, reckless driving, or
9    driving on a suspended or revoked license;
10        (2) has been convicted, within the past 7 years, of
11    driving under the influence of drugs or alcohol, fraud,
12    sexual offenses, use of a motor vehicle to commit a felony,
13    a crime involving property damage, or theft, acts of
14    violence, or acts of terror;
15        (2.5) has been placed on court supervision, within the
16    past 7 years, for driving under the influence of drugs or
17    alcohol;
18        (3) is a match in the National Sex Offenders Registry
19    database;
20        (4) does not possess a valid driver's license;
21        (5) does not possess proof of registration for the
22    motor vehicle used to provide TNC services;
23        (6) does not possess proof of automobile liability
24    insurance for the motor vehicle used to provide TNC
25    services; or
26        (7) is under 19 years of age.

1    (c) An individual who submits an application under
2paragraph (1) of subsection (a) that contains false or
3incomplete information shall be guilty of a petty offense.

5    Section 99. Effective date. This Act takes effect July 1,
62018.
