SYNOPSIS AS INTRODUCED:
 
720 ILCS 642/5

    Amends the Kratom Control Act. Provides that a person (rather than a minor under 18 years of age) shall not knowingly purchase or possess any product containing any quantity of Kratom. Provides that a person shall not knowingly sell, buy for, distribute samples of, or furnish any product containing any quantity of Kratom to any person (rather than a minor under 18 years of age). Provides that a violation is a Class B misdemeanor. Provides that the knowing sale, buying for, distributing samples of, or furnishing any product containing any quantity of Kratom is a Class B misdemeanor for which the offender shall be fined an amount of not less than $500.

1    AN ACT concerning criminal law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Kratom Control Act is amended by changing
5Section 5 as follows:
 
6    (720 ILCS 642/5)
7    Sec. 5. Kratom sale to or possession by minors prohibited.
8    (a) As used in this Act, "Kratom" means any parts of the
9plant Mitragyna speciosa, whether growing or not, and any
10compound, manufacture, salt, derivative, mixture, or
11preparation of that plant, including but not limited to
12mitragynine and 7-hydroxymitragynine.
13    (b) A person minor under 18 years of age shall not
14knowingly purchase or possess any product containing any
15quantity of Kratom.
16    (c) (Blank). A minor under 18 years of age in the
17furtherance or facilitation of obtaining any product
18containing Kratom shall not knowingly display or use a false or
19forged identification card or transfer, alter, or deface an
20identification card.
21    (d) A person shall not knowingly sell, buy for, distribute
22samples of, or furnish any product containing any quantity of
23Kratom to any person minor under 18 years of age.

1    (e) Sentence. Violation of subsection (b) or (c) of this
2Section is a Class B misdemeanor. Violation of subsection (d)
3of this Section is a Class B misdemeanor for which the offender
4shall be fined an amount of not less than $500.
