AMENDMENT TO HOUSE BILL 3882

2    AMENDMENT NO. ______. Amend House Bill 3882 on page 6, line
316, by inserting after the period the following:
4"If the defendant has been charged with an offense involving
5the use, possession, or discharge of a firearm, the court may
6not deviate from a mandatory minimum sentence requirement,
7unless it is the recommendation of a presentence investigation
8and there is clear articulable evidence that the defendant is
9not a threat to the public safety. This must be fully stated by
10the court into the record at the time of sentencing.".
